Rehnquist's death raised the possibility the hearings on Roberts' nomination could be postponed and gave Bush the opportunity of nominating Roberts as chief justice, a possibility administration officials have talked about in the event Rehnquist died.
Sen. Edward Kennedy (news, bio, voting record), a Massachusetts Democrat, said the consideration of successors to Rehnquist and O'Connor should be held off to allow the Bush administration and Congress to focus on the Katrina disaster.
"We should proceed carefully and appropriately in filling these important vacancies. With Justice O'Connor committing to stay until her replacement is named, we can and should remain focused first on protecting our citizens who need help the most," Kennedy said.
Frist said he would discuss with Senate Judiciary Committee leaders whether the Roberts' hearings should be postponed due to the death of Rehnquist.
To fill a second opening on the court, Bush could return to the list of candidates he considered before nominating Roberts to replace O'Connor.
Among the possible candidates are U.S. Attorney General Alberto Gonzales and appeals court Judge J. Michael Luttig. Bush could also elevate a current member of the court such as Justice Antonin Scalia or Justice Clarence Thomas.

Exactly. In fact, crisis tends to focus people on getting the job done. Senator Kennedy doesn't want the nomination process to proceed with a sense of urgency. I wonder why? (not). And it bothers me that Leader Frist consistently lately plays into the rhetorical devices of the opposition. Can someone inform him that he has no shot at the Presidency so stop already trying to distance himself from the current Administration?

Does he mean the President and Congress are heading down to help clean up, deal with the bodies of the dead, facilitate handling of evacuees, etc? AFAIK Frist is the only one down there actually helping. (I do think he's a genuinely good man, regardless of his shortcomings in the political arena.)
There seem to be good people in charge down there now. If they need help, they'll ask for it. They don't need the sort of hindrance that Ted Kennedy et al. with too much time on the hands would provide.
What would fat ted do if there was another 9/11 in the midst of all this? Bush would hunker down and shoulder the load, he would set priorities and get the job done. The dems would run around like chikens with their heads cut off and blame anyone they could for their woes.

Joy Clement (what everyone in Louisana knows her by--that's her nickname) would be an excellent choice for Chief Justice for SCOTUS, and with the disaster down there a practical shoe-in in the senate...

How about this...GWB holds off on a new Chief nominee until Roberts is approved...then Oran Hatch is nominated Chief Justice. I don't think that Chuckie, Teddy, Lady Boxer or "Leaky Lay-Hee" could trash Hatch after all these years claiming comity in the senate. Even if they did, no "Moderate" Democrat would vote against him.
Is not Ted Kennedy's brother-in-law from Louisiana the person who was in hot water on Federal charges that helped persuade him to help implicate other politicians so he might have company in jail?
Is this not the same Ted Kennedy that should have done time for drunk driving and manslaughter over th death of a young lady that he was out alone with (a married man out with a young single lady on a weekend night?)
Maybe the Democrats can get a better mouthpiece than someone who has helped gasoline prices rise over $4 a gallon because of his help in implementing envirowacko policies to plague the US and help cause gasoline shortages.
do you refer to her friendship with Landrieu as a bad thing or a good thing? Politicical vitriol like we see it on the national level has not really penetrated that state much, people who opposed each other on the issues would still gather for lunch and Cafe du Monde and Pat O'Brien's for a cold one at the end of the day (well, before Katrina hit that is) and still go together to The Swamp to watch the Tigers bury their latest victim on the gridiron. Its not that toxic a political relationship down there... corrupt yes, but toxic no..
Make the Senate work overtime. Heck, they will get time and a half.
