Michael Schiavo Poised To Sue Caregivers

CLEARWATER - Michael Schiavo has asked a court to waive the two-year statute of limitations on filing a medical malpractice lawsuit against one or more of his deceased wife's caregivers.
Terri Schiavo, 41, died March 31 after her feeding tube was removed after a seven-year court battle.
Schiavo's attorney in this case, Mark Perenich, said he was not able to discuss the proposed lawsuit behind Tuesday's request for an extension of the two-year statute of limitations.
By law, medical malpractice lawsuits must be filed within two years of the alleged misconduct unless an extension is granted.
In October 2003, Terri Schiavo's feeding tube was removed on court order. Doctors reinserted it on orders from Gov. Jeb Bush.

You wait too long, and you are out of luck, even if you have a great case otherwise. The only exception if for fraud or fraud upon the court. The court will tell him to get lost.

Then he has every right to do so. If there was a DNR and they did not follow it, then they should be sued. If they had followed the law on this, none of this would have happened and we would never have heard the name Terri Schiavo.

You're so clever. It turns out that Schiavo has a legitimate suit. If they ignored a DNR, they broke the law. If they had just followed the law, nobody would have ever heard of Teri Schiavo. I'll donate money for this lawsuit. A DNR is a legal document and must be adhered to.

I believe you are mistaken. Guardians cannot use DNR orders to deny their wards medical treatment. Michael tried that early on, you recall, when Terri developed a uninary tract infection. As he later admitted in court, Michael ordered that she not be treated. That was against the law. The facility overruled him and gave her the antibiotics she needed.
What we learned is that Michael was not only willing but eager for his wife to die of a urinary tract infection -- every woman's nightmare. He knew she could feel pain and he knows enough medicine to know that this is a hideous death.

If they had followed the law on this, none of this would have happened and we would never have heard the name Terri Schiavo. There was no DNR orders posted for Terri until her loving husband won the malpractice award. After that, there was no resuscitation attempt needed for Terri. Maybe you can make something else up?

It turns out that Schiavo has a legitimate suit. If they ignored a DNR, they broke the law. You really need to take a course on logic. Most people develop it naturally, others need help.

I don't know about anyone else, but when I'm tired and try to type fast, one half of my mistakes are homonyms. Perhaps that's so for others, too. There have been charming examples all day, of which my favorite, with apologies, was "towing the liberal line." I can just picture the liberal line dangling out the back of a car or an airplane. Maybe liberals hang their laundry on their liberal line.
Correct is "toe" the line, but what fun is that? :-)

Real guardians who care about their wards were up in arms that HINO was named guardian of the year. The controversies are not going to end any time soon.
Too many Floridians are saying enough is enough with the coverups, corruption and frivolous lawsuits.
