And the mother is exempt from any responsibility here?
Um, first question, what was the child doing in the washer in the first place, ahem, anyone, anyone???????? Where does she get off suing the manufacturer? I can't stand these idiot lawsuits and the assinine lawyers that take them.
And just why did Mom allow the girl to climb into the machine in the first place......?
Hopefully, they machine had a warning label advising as such.
Parental negligence is why this little girl is dead. Not intentional, for sure, but still that.
How did the girl close the door from inside the machine?
Or, did someone close it for her?

(If what I just wrote makes you sad or angry,
A very macabre death. If we have to start the blame game, then I would point my finger at the mother.
The family tries to exonerate the brother by saying that he did not have eleven quarters, but their suit specifically charges that these machines are prone to starting without any money being inserted.
This family is seeking to be rewarded for their negligence.
washers don't kill people, people kill people,
guns don't kill people, people kill people,
suv's don't...
aw hell, sue them all, get a washboard & a slingshot & a horse & buggy...
Sorry, but I don't buy it. Laundromat patrons frequently pump the quarters into the machine ahead of time, then when the lid closes, presto, it runs. I'm guessing mom had already fed the machine, then the poor girl closed the lid and it was all over.
First it was SUV's, now it's coin-operated washing machines being diabolical child-killers....
I agree that mom was negligent, but what kind of washing machine in a public place has no emergency stop and no way to open it while running.
Even shop tools intended for use by trained adults have emergency stop buttons.
I'm on the fence on this one. I say award some money to mom, and then hang her for criminal neglect.
I think her brother did her in. The girl could not latch the door from the inside. The washer cannot start without latching the door FROM THE OUTSIDE.
Every time I go to a service station, I put the fuel nozzle in my mouth for a few second before I use it. I figure one of these days, it's going to squirt gas down my throat, and then I'm on Easy Street, courtesy of Big Oil.
like i have said. bill 397 should not be a gun bill it should be a general liability bill. your stupidity, negligence, criminal activity, etc is not cause for lawsuit or justification to turn you into an independantly wealthy person. in many cases we already pay your welfare so you can live better than some of us, now we should pay so you can live better than most of the rest of us too?
This episode repeat was just on CSI last night. Two kids got drunk at an older sisters party while the parents were away on vacation(not too far fetched). The kids got kicekd out of hte party by the sister, and they went thru the town doing stupid things. THey went into a laundry mat and oen asked the other to turn on the dryer while he was inside. The other kid did so, then took off when the kid ended up dying from the injuries. At the time the managet had gotten laundry detergent thrown on him by a customer(not exactly sure about this part) as the kids were running amuck and ruined some of the customers cloths. When the manager returned, he found the kid and wheeled him out to the bus stop that was right outside the door.
The reason he did it was the liability concerns. Sounds about right, given this story.
So...who closed the door, anyway? You trying to say you wouldn't see a 5 year old in the machine? You cannot pull those things shut from the inside. This story stinks...smells like a rat.
