LAND FIGHT HITS HOME FOR JUSTICE (Libertarians to seize USSC Breyer's vacation home for park)
NY POST ^ | July 30, 2005 | AP

PLAINFIELD, N.H. — Libertarians upset about a Supreme Court ruling on taking land have proposed seizing a justice's vacation home and turning it into a park.

Signatures are being collected for a petition to ask the town to use Justice Stephen Breyer's 167-acre Plainfield, N.H., property to create a "Constitution Park" with stone monuments to commemorate the U.S. and New Hampshire constitutions, said party Vice Chairman Mike Lorrey.

...........Lorrey told the Valley News. "This is a way of saying, 'You're going to be held to your own standard.' "

Lorrey said the Libertarian petition would place the land-taking request before a town meeting next spring. But Plainfield Town Administrator Steve Halleran said yesterday that he didn't expect voters to support the effort.

The Libertarian Party objects to the high court's June ruling that let New London, Conn., take land by eminent domain and turn it over to a private developer.

Breyer supported the decision, as did Justice David Souter. Earlier this month, a member of the libertarian Free State Project suggested that the town of Weare, about 45 miles southeast of Plainfield, make Souter's home into a "Lost Liberty Hotel."

The Supreme Court's 5-4 court ruling said municipalities have broad power to bulldoze people's homes and put up shopping malls or other private development to generate tax revenue.

It would fit the Kelo criteria much better if it were converted to a shopping mall or a Wal-Mart rather than a park since tax revenue will be much higher from a commercial entity. Arguing for a park seems to me quixotic at best.

I would imagine any plan would have to comport with uses for the land that are most amenable to approval.

Maybe they should propose building a National Gay and Lesbian Recreational Area on the property; if nothing else, we'd get to watch Breyer either acquiesce or get vilified by his progressive fans.

"Maybe they should propose building a National Gay and Lesbian Recreational Area on the property"

They could call it:

"The Justice Breyer Sodomy and Turkey Baster Institute."

Whatever they wish to call it, someone needs to get the high disposable income, urban, alternative lifestyle set on board- the press would suck up to them, the 'rats would bend over for them, and Justice Breyer would end up either an "inclusive hero" without his property or a "judgmental homophobe" with his property. Couldn't happen to a nicer plutocrat.

The Kelo angle - money, money, and more money - doesn't rule out anything. Heck, make it a niche-market Six-F(l)ags knockoff- put in a rollercoaster called "The Judge." Why, the concessions alone would be a gold mine. Think of all those Subarus in the lot wearing "Get strapped into the Judge" bumperstickers, and languid young men in muscle shirts emblazoned "I got on the Judge and I stayed on the Judge."

I like the idea of a Wal-Mart. It would show how the leftist Supremes put corporate interests ahead of the rights of ordinary people. Another possibility is to put up a shopping mall.

Or they could go "diverse" and have nightclubs and gay bars, stores that sell liquor, etc. Maybe a bar for gay males and another bar for lesbians and a liquor store for the homeless people. Homeless drunks would be pissing everywhere, gay transgendered-looking males would be prancing around making use (wink, wink) of public restrooms and burly lesbians would be having fights everywhere.
