Statement by DNC Chairman on the Nomination of John Roberts to the Supreme Court

Faced with a growing scandal surrounding the involvement of Deputy White House chief of Staff Karl Rove and Vice President Cheney's Chief of Staff Lewis Libby in the leaking the identity of a covert CIA operative, President Bush announced his nomination of John Roberts to the Supreme Court late this evening. Democratic National Chairman Howard Dean today issued the following statement on the nomination:

"It is disappointing that when President Bush had the chance to bring the country together, he instead turned to a nominee who may have impressive legal credentials, but also has sharp partisan credentials that cannot be ignored.

"Democrats take very seriously the responsibility to protect the individual rights of all Americans and are committed to ensuring that ideological judicial activists are not appointed to the Supreme Court. The Senate Judiciary Committee will now have the opportunity to see if Judge Roberts can put his partisanship aside, and live up to a Supreme Court Justice's duty to uphold the rights and freedoms of every American and the promise of equal justice for all."

I've noticed that lately,too.

Also noticed in Howie's statement,he doesn't mention the Constitution.Apparently it's meaningless to him,since in his mind it's still "evolving".

Partisanship is now dominating the war. MoveOn is desperately promoting;

    As a partisan lawyer for the Bush Sr. and Reagan administrations, Roberts threatened:

    Civil rights by asking the Supreme Court to severely limit the ability of district courts to desegregate public schools, and working to ensure the Voting Rights Act could not be used to remedy many cases of actual discrimination against minority votes.

    Women's rights by fighting for a law barring doctors from even discussing reproductive options in many cases, and arguing that Roe. vs. Wade should be "overruled."

    Free speech by arguing to the Supreme Court that political speech that some considered offensive did not deserve First Amendment protections. The Court rejected his claim.

    Religious liberty by arguing to the Supreme Court that public schools could force religious speech on students. Again, the Court rejected the argument.

Beware of the Commerce Clause

There's something that needs to be emphasized here. Is there any time, any time at all in the past year when the President could have announced a Supreme Court nominee and not have been accused of attempting to smother an incipient scandal? It would've been the Ohio recount or Jeff Gannon or the DSM or some other crap, but the left has been constantly throwing things at the President in hopes that something would stick, and there's been a never-ending barrage of pseudoscandals that would allegedly have been the reason for the announcement of a Supreme Court nominee.
