Appeals Court overturns lower court pro-terrorist ruling

BREAKING NEWS [Shannen Coffin]

In Hamdan v. Rumsfeld, decided today, the D.C. Circuit Court of Appeals reversed a lower court ruling that invalidated a military tribunal against a detainee at GTMO, who just happened to have been Osama's personal driver. In short, court held that commissions were authorized by Congress's post-9/11 authorization of the use of force, that the Geneva Convention was not enforceable in federal court, and even if it was, it didn't provide "prisoner of war" protection to an unlawful combatant like Hamdan.

Finally, a court following the rule of law! What a concept.

Any idea what "commissions were authorized" means?

Thanks.

that it undercuts the entire "prisioner's rights" case that the lefties are attempting to build.

Not it will stop them them from spoutting the same old lies.

The USSC may not even take it.

Its amazing how the Judges start ruling when there is a SCOTUS nomination up for grabs.

I agree with the ruling. Its just suspicious.

very good news indeed.

but I fear what will happen on the SCOTUS - I think they have 5 votes to reverse this.

does this mean that the planeloads of ACLU lawyers we are forced to fly down to Gitmo every week - will stop? I imagine this decision has no bearing on the Padiila case.

Paging Mark Levin...

A good sound verdict, but wait till the heads on the SCOTUS decide to bring in law from Syria to make their ruling.

But no mention of the Constitution itself? Eh well, who cares about that anyway...

They are outside the law just like pirates, brigands, freebooters, looters and filibusters. Summary execution at the point of capture has been the norm since ancient times.

The opinion was written by Judge A. Raymond Randolph (appointed by Bush/41 - 1990). He should appoint Judge Randolph to the Supreme Court. Any Senator who stands against him will be branded "soft on terrorism."
