FOR PETE'S SAKE [K. J. Lopez] In the last half hour the new rumor that is keeping political geeks awake: Rehnquist and Stevens resign tomorrow. (Up until a little ago, the buzz was Renquist, as I noted in Bench Memos.) Posted at 10KùOÅ5 PM (yesterday)

There's an arrogant, unreliable source if I ever heard one.

In fairness, he predicted the O'Connor retirement several days earlier than anyone else.

He can be arrogant and elitist, but he seems to have good sources. :)

Something just hit me -- if there were a bunch of resignations, Al Gonzales could end up being a token "liberal" bone to toss to the commies to keep them from burning the capitol down.

Just a few days ago I was saying that Stevens won't retire under a Republican president unless he has already been dead for a week. I guess I must have missed the news of him passing away while I was on vacation.

Ever see Weekend at Bernie's? If Stevens died they would just prop up his corpse in a chair.

If Bush gets to pack the courts, along with everything he's done overseas, his legacy will rival Reagan, FDR, Lincoln, and Washington. If only he would understand about the borders, or at least be able to mount a convincing argument without doubletalk about why the situation is what it is. (there isn't one)

Stevens would be huge. Probably all out filibuster...

Oh yeah it would get real nasty. I can see the democrats running a bunch really nasty adds as well.

Naw, he's not scheduled until the last year or so of President Bush's term [07/08] time frame.... assuming there is a vacancy then. jmo.

There need be _no_ long-term vacancies on the Supreme Court. And, there need be _no_ more filibusters of any Supreme Court nominee, no matter how hard-right conservative that individual may be.

Once seated by recess appointment, I'm not sure of exactly what "route" permanent confirmation must [Constitutionally] take. But I believe that using the recess-appointment "weapon" will - in practicality - FORCE upon the Senate the obligation, at some point, to conduct an up-or-down, majority-wins vote.

As a historical note, Earl Warren (whom Eisenhower considered to be his "greatest mistake") was in fact originally seated by a recess appointment to the post of Chief Justice.

This is what G.W. Bush _should_ do to thwart the obstructionists.

But it is also what he _won't_ do...

Maybe that is why the announcement time frame of O'Connor's replacement has slipped some. Wasn't it originally stated by the WH that it would come after he got back from the G8 conference and now it's being said sometime later......

I am new at this so here goes. What are we all going to do if Bush doesn't come through? I mean if he doesn't take the opportunity to put conservatives on the bench to replace the three that will retire. For me I really wonder if I will be able to ever vote again. I don't think I could ever trust the republican party again. And I could never be a democrat even at the threat of death. With so many important issues coming before the supreme court if Bush lets us down, then what? And what do we do now that could get the message to the republicans? Serious ideas!

this would be outstanding news. If the resignations were to happen at once and soon, then the SC would be virtually shut down until the vacancies were filled, right? The dems could be more successful in stalling the filling of a single vacancy than 3 of them.

I think they would have to be reappointed or voted on in the next Supreme Court term, which is a year. I don't see the democrats budging on this at all. If any liberal on the court steps down, it is going to be all out war. I think the democrats are clearly ready to fight this out till Bush's presidency is over.

That is incorrect thinking. Gonzales must be first or not at all. The longer he is AG, the more cases he would need to recuse himself from as an associate on SCOTUS.

Gonzales is now or never. (hopefully never).
