Leading Senate Judiciary Democrat Charles Schumer said Sunday that he intends to make gay marriage an issue in the upcoming confirmation battle over President Bush's pick to replace retiring Supreme Court Justice Sandra Day O'Connor.
"All questions are legitimate," Schumer told ABC's "This Week." "What is your view on Roe vs. Wade? What is your view on gay marriage?"
"They are going to try to get away with the idea that we're not going to know their views," Schumer complained. "But that's not going to work."
The top Democrat's mention of same-sex marriage in the same breath as his party's primary litmus test issue, abortion, raised a few eyebrows.
"How does he suddenly have the chutzpah to ask that as a litmus question when he himself opposes it?" WABC Radio host Curtis Sliwa wondered Tuesday morning.
Schumer came out against gay marriage in 2004, after New Paltz, N.Y., Mayor Jason West performed nearly two-dozen same-sex unions.
As a congressman in 1996, Schumer voted for the Defense of Marriage Act, which authorizes states not to recognize same-sex unions from other jurisdictions.

Bush will get no one confirmed. He will make recess appointments good for 17 months. That's the future we are looking at unless the Senate can get a 65 Repub majority.
I think that the gay marriage question could disqualify a lot of the potential nominees, from the conservative viewpoint.
Currently, the Constitution does not ban gay marriage. So they would all say that it's a state issue, which would not sit well with conservatives.
Of course, I suppose a liberal might think that the Constitution bans discrimination against gay couples wanting to get married, or that the Congress cannot legislate on it.
Hopefully none of the nominees Bush might put forward would say that, though.
I imagine some of these Red State Democratic Senators up for re-election might horse whip the Senator from New York if he does that. They would a snowball's chance in hell of surviving the 2006 election.

Because DOMA isn't SCOTUS proof, and Dems know that, so they can say they are against same-sex "marriage" all they want, vote for DOMA, and then let the same-sex "marriage" issue eventually go before the presently liberal-leaning SCOTUS and have traditional marriage butchered there.
That is why the Democrats voted against a Cons. Amend. banning same-sex "marriage". It IS SCOTUS proof.

I believe Chucky has finally lost it. He says he's opposed to gay marriage, but all of a sudden he wants to make it part of a litmus test for a Supreme Court nominee. Pssst! Hey Chucky! The Democrats are pro-gay marriage! Didn't you get the memo?

If Bush sticks to his guns and nominates a "strict constructionist" this would not even be an issue. The so called "privacy issue" is a little lame. The federal government should not be regulating marriage.
OTOH it may take a constitutional ammendment to resolve the "full faith and credit" aspect when some states pass this concession to the multicultural agenda. But if states pass it, (homosexual marriage) it is within their power to do so. It should well be within another states power to not honor same.
They ought to try and ban feet, maybe it will keep them from choking.

No, Chuckie. What matters in a confirmation hearing for Supreme Court is the individual's ability to rule based on what the constitution says, not on what the individual wishes it said.
I agree. Make it a requirement that the person must believe "one man and one woman" for marriage.
And when did the world decide that this 1% of the population needs so much damn attention? It's been estimated that there are more pedophiles in the total population by several percentage points than the number of queers in the country. So? When is Charles SHOE-MAHH going to start demanding that pedophiles get what they want?
