Any nominee should be grilled to see where they stand on the 9th and 10th amendments, the commerce clause, general welfare clause, 2nd amendment, incorporation doctrine, and original intent. If they don't come down on the issues like Clarence Thomas, they should be passed over.

I would add Kelo as a litmus test. If they cannot manage as strong of a stand on Kelo as Justice Thomas on this issue, then we don't need that justice.

You can make book on it - Bush will emulate his pappy and give us a moderate, or closet liberal like Souter. He will blame Congress, blah blah blah. Just like CFR, no vetoes, caving on nuclear option, Bolton, etc. Don't get your hopes up here folks. Sandra wasn't too reliable but she may wind up being better than the replacement.

It would never be Bork. In fact, I've been told that one of the reasons Bork was "borked" was because there was no way in hell the Republicans in the U.S. Senate wanted him confirmed -- so they let the Democrats do the dirty work to make sure he was rejected for "partisan" reasons.
