It is time to change the national anthem. The land is no longer free. Last week, in an appalling decision that will prove to be every bit as infamous as the Dred Scott and Roe v. Wade decisions, the Supreme Court eliminated the American right to property and in one fell swoop, converted the country into the legal equivalent of a Third World society......

I get very nervous when I hear Big Buisness and Big Government are "partnering" in anything.

I think the rule is that is you are a private citzen and own "desirable" land, you are basically a valid target for theft by those profiteers and socialists who have "better plans" for your land than you do.

I agree with your characterization of our ruling junta as elites but this decision more closely resembles fascism then socialism. Socialism would imply that the state had claimed public ownership of the land but in this case it was forcibly transferred from one private owner to another.

While fascism is frequently equated to racism and used as a slur against conservatives when the left lacks a better argument, this is a bad misuse of the word.

Fascism is a political/economic system that combines totalitarian rule (complete with its disregard for individual rights) with directed partnership of and with free enterprise. Industry thrived under Hitler and the trains ran on time in Italy. This case which trampled the rights of an individual for the mutual benefit of the State and Industry looks a lot like fascism.

In this session the Supreme Court made three decisions regarding property rights. We have discussed the Kelo eminent domain case at length and its damage to individual real estate property rights. But they also decided that the cable industry was secure in its property rights and would not be required to share its cable infrastructure with competitors. And they made it easier for the music industry to protect their copyright property by opening the door to sue file swapping companies.

The message is clear. If you are a large taxpaying corporation which supports the elite junta your property rights are secure. But if you are just an average Joe Blow individual your property rights amount to a fart in the wind. It smacks of fascism!

Isn't the SC the highest in the land? How then, can a state (law) ignore the SC ruling if a company wants your land?

The SCOTUS had no constitutional authority to even hear the case. That hasn't stopped them before. But in direct answer to your question, ignoring a SCOTUS ruling is easy. They have no troops to enforce it. All it takes is for a state legislature to say out loud that they're not impressed. That would bring down the whole glass house. Hopefully, it will happen soon.

In this case, however, that is not likely to happen. The court ruled in favor of the state's interests. If the homeowners who sued choose to ignore the ruling of the courts, they will likely face police action by the state of Connecticut. I wonder, though, if Connecticut will have the guts to enforce the ruling. That just might start a wildfire.

Then again, Americans are pretty soundly asleep. They may not wake up until it is far too late, if it isn't already.

I am not sure if the Supreme Court would have made this decision, if both parties had not already been bought and paid for. Al Capone is dead. Today's racketeers are politicians, lawyers, and lobbyists who do the dirty work of those who really have the money and power.

Since 9/11, sad to say, we seem to be on the fast track to lose all our rights as individuals.

Sadly, GWB will not leave a good legacy if this crap continues without any effort by him or his administration to curtail these abuses.

I can only believe that our government, on all levels, considers it perfectly fine to punish law abiding citizens who are easy targets.

CT is in favor of it! They argued that the private office building would bring in more tax revenue than the homeowners would and was therefore in the public good.

You are absolutely right. What is happening to our country is not only disgraceful, it is downright scary.

I'm getting flamed on another board here because I made the "outrageous" claim that there is very little difference between the pubs and dems. I said that they are now basically the same party that only differ in what they say to get into power; once there they act exactly the same. It makes me wonder if both major parties keep their supporters argueing with each other on purpose so that they can both continue to rape us while we're distracted.

Very well stated, now I understand better the difference between the two "ism's".

I really should be more careful when labelling something as "socialist" or "somethingist". It was a knee jerk reaction after reading the article. Thanks again.

Any further input on this would be great, because people get turned away by the topic "eminent domain".

Have you ever noticed, the bigger the injustice being shoved down our throats the bigger and more vague the term used.

Same with the medical industry. Can't they just be honest with us.

It is very hard not to grow weary, but we must keep are heads up and remember the history of this nation.

Nope. The Government has already practiced this scenario. Waco comes to mind. As does Carl Drega. Extreme examples, but ones which point out that while the public may get riled up a bit, they'll do nothing.

If it comes down to buring the New Londoner's out of their homes, most people will just smile, nod, and go back to watching American Idol.

Thank you for your response. So, if I understand correctly by this comment

I take it that if the State reps that are trying to pass a bill that would prevent the State from seizing your property, illegally, are successful, this would set many property owners mind at ease?

However, if the State takes the owner to court, then they would most likely win since the SCOTUS has already ruled in their favor?

Am I understanding this correctly?

I-40 around Durham, NC is another example of that. The original plan had the highway going through Duke Forest, an area owned and populated by the gentry of Duke University and the old money of Durham (liberal socialists, every one). They backed the highway up and took it 12 miles out of the way. The project was also delayed for years while the battle was fought in smoky back rooms of the Democrat oligarchy in NC.

The only problem there is the more tax money generated the more fools there are to spend it...

They are all out of control spendthrifts...drunken with power and taking others money by force of courts, threat of SWAT teams and prisons.

The more money they get the more they spend and like giant insane babies scream for more money..they are never sated never satisfied..

Sure they may take your land and thereby gain more taxes but they are corrupt and 'the people' will gain nothing good..so there will be little if any public good done with the tax money collected...

Thieves don't do good with their ill gotten gains...and neither do immoral politicians.

They keep testing 'we the people' to see how much constitutional erosion we will take...they obviously care nothing for our laws that keep them from taking more money.

Yet they are foolish..they can steal all the ghetto property and put up McDonald's and then a group of politicians comes along promising to give the displaced brand new homes built with those same tax dollars..and soon they tax their corporate cows out existence..

One thing you can count on..politicians will either kill their golden goose..to get a vote..or frustrate it till it quits laying eggs.

The government already essentially owns all land anyway. We just pay rent to live on it and build on it. This rent is called property tax.

Depends on the issue. There are massive differences between the Dims and the Repubs. Mostly on the issue of Nationalism and civic duty.

On the front that most people deal with on a daily basis, no... there is no difference. Both seem to want less Constitution and Rights, and more power for themselves. There are only a handful in either house, one or two Justices, and a couple pundits that can truly be called "conservative". That as far as a domestic agenda goes, Bush cannot be numbered among them, is sad if not unexpected. We knew Bush wasn't the worlds Greatest Conservative when we elected him. He just wasn't as bad as Kerry. The President could go a long way towards fixing that image if he would have done something, ANYTHING, with his Veto stamp to slow down the increase in the Fed Budget. Vetoing anything at this point would almost seem out of character.

Our Country was lost a long time ago. The FedGov has BEEN completely off the hook for some time now. Some put it during the Clinton years, some to LBJ, some like me back to Lincoln. The loss of being able to exercise our Natural Rights without having to worry about some government agent or another wanting to arrest or kill us, is undeniable.

Whining about it won't change things either. Stirring up things here by trying to directly equate Republicans and Democrats isn't going to do any good either. Don't just call people names. Work to change those ideas that you can, leave the Bots alone. Don't let their slander go unchallenged, but don't just attack them without giving the facts as you see them either.

And yes, the Big Two Party system has been accused of coercion here before as well. However, extreme claims require extreme evidence. If you have evidence of such collusion, post it in a thread.

There is no difference. My friends laugh at me for going to Florida for a week to volunteer in 2004 to help re-elect GWB.
I can only agree with them at this point and even feel like I have some part in this chaos.

I live in NY. It is sad to see how bad the RATS and RINOs are. Both are terrible and squander our money.
