Bush Asks for Schiavo Investigation

TALLAHASSEE - Gov. Jeb Bush asked a prosecutor Friday to investigate why Terri Schiavo collapsed 15 years ago, calling into question a gap in time from when her husband found the woman and called 911. In a letter he faxed to Pinellas-Pasco County State Attorney Bernie McCabe, Bush said Michael Schiavo testified in a 1992 medical malpractice trial that he found his wife collapsed at 5 a.m. and he said in a 2003 television interview that he found her at about 4:30 a.m. He called 911 at about 5:40 a.m.

"Between 40 and 70 minutes elapsed before the call was made, and I am aware of no explanation for the delay,'' Bush said. ""In light of this new information, I urge you to take a fresh look at this case without any preconceptions as to the outcome."

Terri Schiavo died March 31 from dehydration after her feeding tube was disconnected despite unsuccessful efforts by Bush to keep her alive.

The battle between her husband and parents over whether she should be allowed to die also engulfed the courts, Congress, the White House and divided the country. Her autopsy, released earlier this week, showed suffered from severe and irreversible brain-damage.

McCabe was out of state Friday and couldn't immediately be reached for comment.

Michael Schiavo's attorney, George Felos, did not immediately return a telephone call seeking comment from The Associated Press. But in comments published Friday by The Miami Herald, he said Terri Schiavo would not have survived if her husband had not immediately called 911.

"It's absolutely preposterous,'' Felos said. "If he had waited 70 minutes she would have been dead.''

Dear Mr. McCabe,

Wednesday the Chief Medical Examiner for Pinellas County issued his report on the autopsy of Terri Schiavo. While the report clarifies many questions surrounding the case, it leaves some unanswered.

Of particular interest are the report's findings as to the cause of Mrs. Schiavo's original injuries. The report indicates that there was little evidence of an eating disorder, previously the lead theory of the cause of her injuries. The report also indicates that blood tests conducted on Mrs. Schiavo in 1990 upon her collapse were routine and would not necessarily have detected or ruled out many types of drugs or toxins. The report rules out any overt or blunt trauma, but could not rule out or positively identify other causes. As a result, the cause of her injuries is more in doubt than ever.

Also of interest is the gap in time between Mr. Schiavo's discovery of Mrs. Schiavo's collapse and the 911 call he made to request assistance. According to Mr. Schiavo's testimony in the medical malpractice trial in 1992, he discovered Mrs. Schiavo had collapsed at about 5:00 a.m. According to his comments in a 2003 television interview, he found her at about 4:30 a.m. According to the Chief Medical Examiner's report, Mr. Schiavo placed the 911 call at approximately 5:40 a.m. Between 40 and 70 minutes elapsed before the call was made, and I am aware of no explanation for the delay.

In light of this new information, I urge you to take a fresh look at this case without any preconceptions as to the outcome. I understand that these events took place many years ago, and that you may not be able to collect all the relevant records and physical evidence. However, Mrs. Schiavo's family deserves to know anything that can be done to determine the cause and circumstances of her collapse 15 years ago has been done. The unanswered questions may be unanswerable, but the attempt should be made. Thank you for your consideration of this request.

Like Randall Terry, George Felos had (and has an agenda)

Felos is associated with the far out left spectrum of the bar, and the same goes for Terry and the right.

Both of these lawyers took these cases because they thought they could get political mileage for their causes, I don't believe for a second that either Terry or Felos gave a damn about their clients. These are lawyers, thats alone reason to be suspicious, but these are also lawyers who have a reputation of taking high-profile, high attention cases which happen to be controversial.

Am I misunderstanding your meaning? Randall Terry wasn't the Schindlers lawyer.

You are partially right, but not entirely. Randall Terry was not their lawyer, was invited in as a friend of the family to help them and that he did. He spent lots of time working in the background away from the cameras because of the issue, the horror of the impending murder. Randall Terry was there as one of many all working together against the atrocity.

This isn't belief or emotion. It is fact.

Jesse Jackson, though, did show up, and did get before the cameras.

The same kinds of arguments in favor of Euthanasia are rearing their ugly heads in cases like Terri's. And far too many people are buying them.

Randall Terry saw it as a way to pivot himself as a leader again in the pro-life movement. I do think Terry is sincere about his beliefs. However, I don't ever want to see him or people who would utilize his kind of tacitcs leading the charge against Euthanasia or hold any leadership position in the pro-life movement again ever. He caused the movement enough destruction during the first go round.

I disagree. This is the kind of hallmark case that needs a full review. It affects all of us.

He didn't seem to be leading any charges, like Rev. Pat Mahoney and others were doing vigorously. Others were spokespeople for the Schindlers as well.

More than a pro-life effort or an anti-euthanasia effort, it was a pro-Terri effort first and foremost.

DUNEDIN, FLORIDA, June 18, 2005-Calling Governor Bush's request for an investigation an "outrage," Michael Schiavo states, "I have consistently said over the years that I didn't wait but 'ran' to call 911 after Terri collapsed." As to the time of the 911 call Mr. Schiavo states that, "I wasn't wearing a watch or looking at a clock and I have stated in my sworn testimony that 'I'm not good with dates and times, like I told you before' " [January 24, 2000 testimony]

As the following show, Mr. Schiavo has never stated an exact time of Terri's collapse:
"Q That was the early morning when you woke up to Terri's collapse?
A Correct.

Q …you found her after her heart attack on the floor about 5:00 in the morning…is that right?
A Correct." [direct and cross examination from November 5, 1992 malpractice trial]

"Q …tell me what occurred on February 25, 1990?
A I got home late from work that night…A few hours later I heard this thud. So I ran out into the hall and I found Terri on the floor…I turned her over going, 'Terri, Terri. You okay?' I laid her down and ran over and called 911." [January 24, 2000 testimony]

"Q What happened Michael on February 25, 2005?
A …I came home around 2:00 in the morning, climbed into bed…I'd say about 4:30 in the morning…I head a thud in the hall. I raced out there and Terri was laying in the hall. I rolled her over and she was lifeless…I ran over, I called 911" [October 27, 2003 statement on Larry King Live]

"Her husband heard a bang about 6a.m. and found his wife on the floor with difficulty breathing…and unresponsive. The paramedics were called right away…" [February 25, 1990 admitting records from Humana Hospital-Northside]

As all of the above information has been on the record for years, and never made an issue, Mr. Schiavo asserts that this newly created non-issue "is meant to deflect attention from the fact that the Medical Examiner's report has shown the Schindlers' claims and Governor's position to be untrue." "It is sickening that the Schindlers and Governor Bush, for their own selfish reasons, want to keep this case going."

Noting that almost everyone realizes that remembering exact times from fifteen years ago is impossible, Mr. Schiavo concludes, "For sensible people the autopsy report gave closure in this case. I hope that everyone can finally put this matter behind them."

Really, so where in the Bible does God say it is the mind that makes the man. And not all of Terri's brain died 15 years ago, only some of it, so therefore seeing she still had some brain left technically she had some life left. I agree once the brain dies you are dead, but this was not the case with Terri.
