TRANSLATION: We kicked their tails in this so-called "deal." We are getting everything we want and gave up nothing but a "promise" that we know they will BREAK, thus freeing us.
Which is exactly what I said a couple of weeks ago when everyone here was freaking out.

The Minority Leader, Reid, D, NV, spoke before Frist called for the vote. Reid lamented that Justice Brown could not be counted on to follow Stare Decisis -- stand on a prior decision and don't overturn it. Then he went on to pull the rug out from under himself (a neat trick) by lauding the 1937 Supremes (they had gotten the message and turned less conservative after FDR's court packing scheme failed) who overturned the Lochner decision from the early 1900s. So overturning existing decisions is OK when you didn't like the original decision to begin with but is Judicial Activism when it goes the other way. I think I already knew this.

True but replacing Rehnquist with a solid middle aged conservative might well be a 30 year hold until say 2035! A hold is a pretty big deal on the Supreme Court. Certainly we need a few Souters to resign too.
I agree, however we need longevity on the bench too. If there's any chance of having a Dem in the White House in 2008, anyone feeling ill or old now needs to step aside. As much as I like Rehnquist, I've love to see him replaced with someone of Scalia's stripe who is 25 years younger than Rehnquist.

reminds me of the story of the disaffected worker who threw the proverbial monkeywrench into the heavy machinery. As the gears ground to a halt and everyone had to troubleshoot the problem and try to fix it, he chirped to his bosses: "Gee, productivity around here really stinks, huh?"
