Frist just basically told the RINO's to go to hell on hannity. The first filibuster he pushes the button no matter what they agreed to.

Put your money where your mouth is Frist.

Bring up the ones "left out" in the "deal."

When tehy are filibustered, invoke cloture.

Then, like any good leader would do, he would rally enough support among his own party to break the filibuster.

IMO Frist could have solved this problem a long time ago, when the Centrist RINO's didn't have enough time to think (not that they ever do) and called for a motion on the floor to invoke the Constitutional option.

Had he done that early, we wouldn't be talking about it now.

I can't really be upset with Frist. He was hamstrung.

McCain and his merry band of sellouts need to feel the wrath for this one.

Well, after listening to Senator Frist on Hannity's radio show, and now He is talking to Pickering....

I fear my first instincts were correct. This is a huge loss for the GOP in general, and for conservative aspirations in particular.

Reading between the lines (he couldn't bring himself to say so directly), Frist believes that McCain & co. not only stabbed him in the back, they really ursurped his power.

The more I think about it, I'm now thinking that the mentally unbalanced McCain and his cohorts are planning to position themselves as "moderates", and draw off the more centrist Dems and "wishy-washy" Repubs into a "new" political party.... Perot revisited, except the target is not to draw conservatives but "fence sitters".

McCain: Drop the Mc, call true conservatives Abel, and you get a perfect picture of what has happened out of the Bible.

Monday night's bipartisan deal prevented a vote on Frist's proposal, as seven GOP senators promised to vote against it.

The Senate's 81-18 agreement to vote on the nominee prevented a vote on Frist's proposal.

From what I have gathered, Frist is no longer in charge. Six dems and six rino's are. Has Bush spoken out on this today? (I just got home from work.)

At anytime during a filibuster of a nominee Frist can ask the President of the Senate for a constitutional ruling. Cheney would then declare the Senate rule unconstitutional and non-operative opening the path for direct up/down votes. McCain would be left out in the cold (where he belongs).

I'd wager that having Frist in this position is a part of the deal, that isn't formally in the deal.

IOW if the dems "default" then the whole deal is off, back to nuke option mode.

And if it goes that route (eg. the dems default their part), perhaps some wavering Republican Senators will vote nuke.

One reason Frist didn't just pull the nuke trigger sooner, is that I doubt he was sure of his votes.

Senate Majority Leader Bill Frist emphasized Tuesday that he wasn’t a party to the deal and would quickly try to implement the rule change if Democrats resumed use of the filibuster to derail President Bush’s judicial nominees.

The Senator was quoted as stating: "I really, really, cross my heart...can I say that? ...Hope to die, really, super-truly mean it this time, guys. Stop laughing, it's gonna happen...."

I suspect there is a side deal in this gang of 14 that goes something like this. They have identified a handful of judges that don't get approved as a condition for making the compromise. The RINO's will vote with the democrats to defeat those nominees. So they get the up or down vote but get defeated.
