Here's what it really means:

1) the GOP is willing to accept less than they deserve

2) the GOP moderates actually TRUST the WORD of DEMOCRATS!

Anyone thinking the Dems will be true to their word are morons and gullable fools. They will define "EC" as pimples.

And the RINO's that did this will ALWAYS force another "compromise" that allows the DEMS to get their way.

I think you're all being incredibly myopic.

We get three Justices where we had none. The nuclear option might not have passed anyways. We can probably get more, since the Democrats have backed down much further than we have.

By agreeing to this, the Democrats have implicitly accepted that their earlier stand was not a result of "extraodinary circumstances."

But, in general, as a long-time reader of both FreeRepublic and DU, I'll just note that I could count the number of times that Bush or the Democrats have been declared "finished" by a frenzied mob only using a scientific calculator.

I have two initial thoughts about the deal. First, if Chief Justice Rehnquist retires at the end of this term, as may expect, and President Bush nominates a mainstream conservative to the court (e.g. Michael Luttig, John Roberts, Michael McConnell), if the Democrats filibuster the deal was made in bad faith. Indeed, the only possible "extraordinary circumstance" if a mainstream conservative were nominated to replace Rehnquist would be clearly documented ethical improprieties.

Second, if any of Bush's nominees had to be thrown overboard, I would have picked William Myers to be among them. In my mind, he is the least impressive of Bush's appellate nominees. As for Henry Saad, his fate was sealed an e-mail he sent disparaging a Senator was inadvertently exposed.

I think Frist just lost the 2008 primary though. The nuclear fans feel like he lost control, the "moderates" think that they have wrestled power from him.

Put a fork in Frist, he is done. No judgements being made by me, just hard political reality.

The 6 RINOs will team with the Dems to block any attempt to change the filibuster rule for the next year.

6 RINOS have hamstrung the 49 other Republican Senators.

If we consider that the Demagogues call just about every Bush nominee an 'extremist' it is clear that they can declare "extraordinary circumstances" at any moment they choose, for any nominee who is deemed an 'extremist' by the Demagogues certainly gives rise to "extraordinary circumstances" by their lights.... this compromise merely postpones the real day of reckoning - apparently we should get 3 nominees confirmed (unless there are further RINO betrayals) and 2 have to be tossed overboard. Then, the RINOs will try to dictate to the White House who can be nominated in the future, because without their support the "constitutional option" can't succeed. So in the end this is a bigger power play by the RINOs than even most Freepers may have realized, because now all judicial nominees have to be vetted by them in advance!!! (unless the White House wants to risk being unable to win at the "constitutional option")

Since when has the President had to "consult" with anyone before he submits a nomination to any office? There is no precedent for consulting with the opposition Party.

The Republicans are no longer the majority in the Senate. Six Republicans senators switched parties tonight; whether anybody cares to admit it, or not. These six will never vote with the Republicans again.

Graham says he could vote to end the filibuster in the future.
Did he say what "future" meant? The deal takes it off the table for this senate term.




I got the sense that he meant that he would do it if the Dems don't live up to the DEAL.

What have we lost? The Big Mo ... momentum.
The RINOs have shown that they can defeat their own majority leader and their own president. This will embolden them further in the future. It will be harder than ever to get their votes for the constitutional option, for a controversial nominee, or any other damned thing.

This is an utter disaster.

OK, three nominees might get through now. In the meantime, two others are blocked, there is no meaningful promise whatsoever about the Supreme Court nominations, and no meaningful promise about Bush's future nominees.

Our "moderates" got taken to the cleaners. Or maybe that's not accurate, since they really couldn't care less about the result. They just want everyone to get along. Conservatives on the courts really don't matter to them.

Two quick points responding to the moderates’ deal on judicial filibuster: 1. The national center-right coalition opposing judicial filibusters, and the Senate leadership, will continue to push for an up or down vote on every qualified judicial nominee.

2. The fact that Senate Democrats are willing to allow cloture on Owen, Brown, and Pryor indicates that conservative judicial philosophy cannot be considered the basis for a filibuster, or an “extraordinary circumstance.”
