President's Statement on Judicial Nominations
White House ^ | 5/9/05 | President George W. Bush

Posted on 05/09/2005 2:09:22 PM PDT by advance_copy

Four years ago today, I nominated Justice Priscilla Owen and Judge Terry Boyle to serve on the Federal courts of appeals. Four years later, neither has received an up-or-down vote in the Senate. Both have been rated well-qualified by the American Bar Association, the highest ABA rating a judicial nominee can receive. Both have been waiting to fill vacancies that have been designated judicial emergencies by the Judicial Conference of the United States. Much more than enough time has passed for the Senate to consider these nominations. The Senate should give these extraordinarily qualified nominees the up-or-down votes they deserve without further delay.

It is only fair that the Senate promptly consider judicial nominees on the floor, discuss and debate their qualifications, and then vote to confirm or not to confirm them. Nominees who have the support of a majority of the Senate should be confirmed. Unfortunately, a minority of Senators is blocking the will of the Senate.

Over the course of the past four years, the blocking of judicial nominees in the Senate has escalated to an unprecedented level. Last Congress, ten of my appeals court nominees were filibustered. Each of these highly qualified nominees enjoyed the bipartisan support of a majority of Senators. Each would have been confirmed if given a simple up-or-down vote. Each deserved a simple up-or-down vote by the entire Senate.

I urge the Senate to put aside the partisan practices of the past and work together to ensure that all nominees are treated fairly and that all Americans receive timely justice in our Federal courts.

President Bush calls on the Senate to end the filibuster and hold a vote on his nominations. In other good news, Sean Hannity just reported that Senator Lott sent him a fax denying the report in Roll Call. Lott's statement, according to Hannity, says he is committed to every nomination getting an up or down vote.

The President may as well be barking at the moon. He is wasting his time asking Dems to treat people as they should be treated. There is no issue that comes before the Congress that is so screwed up that it is judged bad by all members of one party while judged good by another. Partisan politics is bullshiite. I wish we could throw out every damned one of them and start over with patriots instead of lobby and Pac owned thieves who pass payraises for themselves easily enough with bi-partisan votes.

Who cares what the DEMOCRATS think - THEY ARE THE MINORITY.

I think the President was speaking to his OWN PARTY.

I wish the pres would have mentioned Janice Rogers. Gotta love these quotes:
From http://www.neoperspectives.com/quotes.htm

Some things are apparent. Where government moves in, community retreats, civil society disintegrates and our ability to control our own destiny atrophies. The result is: families under siege; war in the streets; unapologetic expropriation of property; the precipitous decline of the rule of law; the rapid rise of corruption; the loss of civility and the triumph of deceit. The result is a debased, debauched culture which finds moral depravity entertaining and virtue contemptible.
- CA Justice Janice Rogers Brown

We no longer find slavery abhorrent. We embrace it. We demand more. Big government is not just the opiate of the masses. It is the opiate. The drug of choice for multinational corporations and single moms; for regulated industries and rugged Midwestern farmers and militant senior citizens.
- CA Justice Janice Rogers Brown

The quixotic desire to do good, be universally fair and make everybody happy is understandable. Indeed, the majority's zeal is more than a little endearing. There is only one problem with this approach. We are a court.
- CA Justice Janice Rogers Brown

Government is the only enterprise in the world which expands in size when its failures increase.
- CA Justice Janice Rogers Brown

The public school system is already so beleaguered by bureaucracy; so cowed by the demands of due process; so overwhelmed with faddish curricula that its educational purpose is almost an afterthought.
- CA Justice Janice Rogers Brown

"I think the President was speaking to his OWN PARTY."

Right, why aren't the Republicans forcing the issue with the rules change? The liberal-socialists will never budge until America wakes up and throws them out.

Well .. it's up to us to let them know how we feel.

Voinovich said he had no idea people even knew Bolton's name - after he was overwhelmed with email and phone calls from his caving to Biden's wishes and delaying the vote on Bolton.

So .. there's a lesson here for us .. we HAVE TO LET OUR CONGRESS PEOPLE KNOW WHAT WE THINK ABOUT ISSUES. Even if they're democrats or RINO's or reg repubs.

I use www.congress.com - it's easy to find who you want, and it's east to send a FREE email.

I suppose its up to us. I've called the "Party of Nine", Voinovich, the gang of five and anyone else I can fit in. Running the government from a full-time job is kind of tough - hey, I thought that's why we elected these guys, to represent us. It would save everyone a lot of time if people would get smart at election time. That comes once every few years. Better than trying to run the government from our full-time jobs once the wrong people are in office.

Why did he leave Janice Rogers out? Was she nominated more recently than the other two?

Unfortunately, the WH statement makes it look like he is not supporting her.

I believe these two were the first ones renominated by Specter for Committee hearings/voting, so thats why he is specifically mentioning them. I'm not sure why Specter didn't include J. Rogers Brown in this group because she is probably the best (IMO) ideologicaly up there, although it's just cuz I like her, I admit I'm unfamiliar with many of the others, and politically as well (she'll give the NAA(L)CP crowd conniptions). But, in any case, I think W is just speaking to the current realities, not against any of the other judges he didn't mention.
