Time to prosecute the Free Republic vandal outright. (Vanity)
today | By Lazamataz

Posted on 05/09/2005 5:54:33 AM PDT by Lazamataz

There is an internet vandal who defaces Free Republic with very gross pictures (homosexual sex and stuff from rotton.com) as well as posting "ALL YOU F***** N*****S & JEWS SHOULD BE LYNCHED".

He pings a variety of people to his post, ensuring that the trash is still in their My Posts lists.

To me, this isn't the milder form of harassment that Eschoir engaged in so many years ago. The very worst he would do is ask if you ever committed sodomy, and he once used the screen name "Paula Jones Tw*t". This is mild.

What this sick piece of work is doing is much more egregious. I believe it crosses the line into criminal defacement and restraint of trade. Are there any Free Republic lawyers (especially prosecutors) who can address this issue, and are there any private detectives with internet savvy that will help track the identity of this person down?

We're talking about a criminal prosecution. I see that as tricky.

When I get this same drek from this same individual -- addressed to me specifically -- more than a dozen days in the past month and a half, that counts as harassment in my book. Which is certainly actionable, at least on a civil level if not a criminal level.

No. TMP02 is a respected freeper. TMP02 was just calling attention to the post and the mods because it was taking so long for the mods to respond.

Thanks for the correction.

My apologies!

If stores have to cover adult magazines where kids might see them than I think it would apply here also.

I think Hate crime is more like it.

His posts would certainly be actionable under those statutes -- even if we are conservative... ;)

I am with you!

Something needs to be done!

When he started to post his filth three weeks ago ,my son got a look at it, as he was passing by the computer on his way out.I am only thankful that he is 17 y/o and I didn't have to explain much!

It even made my son mad and he wanted to get the guy !

I am glad that my daughter wasn't the one walking by!

Sorry that y'all are forced to see such twisted images.

I saw the one that thing posted on the Ultrasound thread.

It just convinces me, all the MORE, what kind of mindset of those 'alternative lifestylers'.

The one I call "bathtub woman" is our perp's mother, right after he's done with her. One of the dudes in the other photo is the perp's dad, but our perp doesn't know which. This little creep is to be pitied...all he's doing is posting his pathetic family photos.

Well, it is hate speech, and it is obscenity. This a-hole deserves whatever comes his way.

It would be easy enough to supply all the evidence on hand to FBI, but given this guy's level of persistence, I suspect most of the IP data is spoofed.

I'm afraid you're probably right -- though with persistance, there may be a means to still track him...

I finally hit the abuse button on someone. I guess the old saw "there's a first time for everything" is true.

Did anyone else experience an automatic redirect to some Spanish speaking website? I could not refresh any FR page or bring up any new FR page without it going to some Spanish language blog site. I couldn't even log out. I closed all FR windows and pulled up Drudge to see if it had affected my browser on all sites. Drudge came up fine so I came back to FR and the troll was zotted along with its posts. No more problems after that. Looked like more than a spamming attack to me but I'm not too computer/internet savvy.

I did not know that. I can't imagine how it could be done, either.

I believe you can identify a proxy by polling it back, and if it's anonymous or high-anonymous, deny. Transparant proxies (like those in most businesses) can still come in.

Also, there are many publishers of proxy lists. Scrape those lists and put together a daily floating Denied IP List.

I tell you, the thing that bothers me is that you can be having a perfectly lovely discussion with 50 or so of your closest friends, and then this moron comes along and takes a dump on the Living Room rug. It becomes impossible to continue the conversation at that point. The next 100 posts will be variants of "What the H@ll was that!", and everybody forgets what they were talking about.

In that way, in impedes the operation of the forum and is a very effective device in muzzling FR. For this reason, it must be stopped.

The normal self-policing methods of Administrative moderators being flagged or spotting abuse on their own and banning the culprit forthwith are not working?

I haven't researched the issue in depth, but at a cursory analysis, I think the First Amendment would make any such criminal prosecution theory sink...and you would find it difficult (to say the least) to get a U.S. Attorney to even look at the case (based on a theory of obscenity and interstate trafficking in porn). We weren't able to even get the ban on kiddie internet porn to withstand the absolutists currently haunting the U.S. Supremes.

And unless the perpetrator just so happens to live in your jurisdiction, you will not be able to enlist State or County agencies...which would be even less likely to do anything. Unless you could first obtain a protective order (TRO in legal parlance) to bar the nuisance activity. Then repeated violations would give you more solid standing to go after the character.

The victims and the Corporation (Free Republic.com) would perhaps have standing to bring an civil action sounding in tort law, the tortious interference in business (restraint of trade), defamatory damaging of business reputation, and on the personal level, intentional infliction of emotional distress.

As a furst step, I suggest that the Moderators be given the ability to "nuke" all posts and email by such an obvious troll...and spare the victims the angst that you rightly express. I assume that the guy must be using an alias when he registers.

Perhaps a precondition should be made so that Free Republic posting privileges require a secure ISP-tracking cookie be enabled on the posting system.

Also, I think JR could automatically block any images coming from those domains that host the pics or set up a filter that would identify certain pic names and auto delete them.

Civil suits are far too costly. . . . Here is a place where the State should and could bear the brunt of the cost. We pay taxes; let us use them to identify, prosecute, and jail this individual.

I agree absolutely.
