I wonder why Schumer and Byrd think they are able to hold public office at the same time that they avow that their "primary duty" is to God,* ; but, Schumer thinks others are incapable of doing the same.

Norman Ornstein says Byrd holds reverence for our government institutions. Ornstein says Republicans are using talking points, as if the republican senators say something enough times, it will become so. I find this whole episode dismaying, in it's scope and it's consequences. There's no doubt in my mind if President Bush had called Senator Reid to the White House shortly after the election, there's no doubt in my mind he could have said, I'm putting forth 10 nominees, and I want 6 of them, and an agreement could have been reached. (Ornstein is smoking something!)

Prof Gerhardt is doing the ole shellgame to defend his position. He is using generalities when he needs to gloss over specifics that would contradict his position.
The Prof lumps holding judicial nominees in committee with failure to bring a nominee, voted out of committee, to the floor.
Then The Prof implies that changing that would be precedent-setting. The Prof fails to mention that, holding a nominee voted out of committee, but filibustering the nominee to get to a floor vote, is itself precedent-setting and that precedent was set in the last session of the Senate when Dems held a 1-vote majority (thanks to Jim Jeffords, TC*-VT).
Regrettable, the GOP is doing a typical poor PR job on this issue. When push comes to shove, the msm will skewer the GOP who try to change this. Frist, by not stopping it when it first started with the Estrada filibuster 2-13-03, has painted himself into a corner.
[The GOP have set themselves up to lose this: either they will lose the actual vote to change the rules (now that precedent has been set) or they will lose the PR war in the MSM just like they did when Gingritch shut down the government during the Clinton administration. For the GOP this is a lose-lose now.]
