STATEMENT OF KELLY OVERSTREET JOHNSON, PRESIDENT OF THE FLORIDA BAR

TALLAHASSEE -- The tragic and high visibility case of Terri Schiavo has resulted in an unprecedented and unjustified attack upon our judiciary. Regardless of anyone’s personal or political feelings about the Schiavo case, this is a critical time for Americans to recognize the vital role of the judiciary in maintaining the rule of law and the importance of the separation of powers among the three branches of government.

It is in times like these that we should recognize that our judges, on a daily basis and not just in high profile cases, have the duty and responsibility to protect the rights and liberties afforded to all of us by law.

Judges have no control over which cases come before them and they will inevitably be involved in deciding difficult and unpopular cases. When presiding over a case, judges make rulings based solely on the Constitution and other laws, and not their own feelings or personal beliefs.

While we may disagree with decisions and actions of public officials including judges, it is entirely unacceptable and unfair for our judges to be criticized and even vilified when no judicial basis for such criticism exists. Unfortunately that is what is happening as emotions heighten in the Terri Schiavo case.

Florida newspapers are now reporting that Circuit Judge George Greer has not only been accused of murder and terrorism by congressional leaders in Washington, but has received death threats and was pressured to leave his church.

Societal dilemmas should never be confused with constitutional responsibilities. Florida’s legal profession knows from polling that Floridians want nothing less than a fair and impartial judiciary.

Judge Greer is an ideal representative of the type of judge citizens want to hear their case. His rulings are based on laws, not emotions and not politics.

Indeed, his rulings have been repeatedly reviewed and scrutinized by many different courts on many different occasions. We must continue to have confidence in our legal system and expect our judges to act with the knowledge and integrity required of their position.

Judges are limited by duty to responding to such unfair criticism. But Florida’s editorial boards, community leaders and the 75,000-member Florida Bar are not. The Florida Bar joins many of the state’s major newspapers and democratic advocates in denouncing the unwarranted attacks on the judges and courts which serve everyone in this great country.

I tried the link. Maybe the bill number will get results but Terri's name is not on their search engine at the Fla. Senate.

Can you explain what you mean, or maybe point to some order, instead of just making this kind of blanket remark without reference to any fact? Are you saying the he filed something or appeared on her behalf? What do you mean, "acted as her attorney?" She had three attorneys over the course of the case, and Greer wasn't one of them.

Well, THIS pretty much *sums* it all up, with the exception of explaining the behavior of the LIBpublican RINO Judges?

The death threat was carried out. It was an order for murder. It was most capably carried out. The hostage, Terri Schindler, was slaughtered while the cameras ran outside.

Terrorism and murder. It was both terrorism and murder.

For your information, the attorneys represented Terri's parents, the Schindlers.

Terri was NEVER represented by an attorney. Judge Greer took on dual roles as her guardian ad litem and as her attorney in fact and in addition, he was petitioned repeatedly to recuse himself but would not do so. Judge Greer needs to be investigated ASAP.

Terri WAS NEVER REPRESENTED BY AN ATTORNEY WHICH IS A RIGHT EVEN COMMON CRIMINALS HAVE, IT'S CALLED DUE PROCESS AND A RIGHT TO AN ATTORNEY. This is on the record.

After you read the court pleadings, return and say something based upon your new familiarity with the case(s).

Um, no. The withdrawal of life-sustaining care - as defined by Ch. 765 - pursuant to the procedures ourlined in Ch. 765. is not a "criminal felony," no matter how many times you erroneously say it.

I'm constantly amazed how those who could avail themselves of good arguments in support of their position choose instead to advance frivolous ones.

That's a flat-out lie. She had three different guardians-ad-litem. Perhaps you should read what they had to say. Oops, I forgot - you won't agree with them, so they must be part of some shadowy conspiracy.

Do you want to make a change and see some justice? Congressman Tom DeLay said the House Judiciary Committee will be investigating Terri's case and making recommendations to the full house about any reforms that they believe are necessary in this debacle over Terri's life and death.

This thread is to brainstorm, and to report what contacts we have made and the results. Below is a link to the committee members.

Anyone who wants to help organize a ping list- SPEAK UP. We need someone to make a list of objectives and contacts.

This thread is for activism. If you are not interested in that - please move to a different thread. I am done with the flame wars.

One might wonder why those who are claiming to be on the side of right feel such a strong compulsion to exaggerate reality in order to push their point.

There is no law against any student praying in school.

There is no ban on the ten commandments in public places, except where they are promoted by the government authority in a way that makes them "official" policy.

Go ahead and believe Mr. Perkins, if it makes you feel better.

While you are at it, ask yourself if you favor the appointment of Judge Priscilla Owen, the President's nominee? And, if you do, tell us how you feel about the Attorney General's characterization of her rampant judicial activism?

The denial of FOOD and WATER to a disabled person, is most CERTAINLY a *FELONY*!

Not to mention, that the very GAL that Greer assigned to Terri in 1998, when MS first requested that Terri be starved and dehydrated to death, specifically stated in no uncertain terms to JUDGE GREER, that it was his opinion, that MS, given the substantial CONFLICT OF INTEREST as terri's Guardian, was not able to PROVE *clear & convincing evidence* and thus, it was his recommendation and opinion, that terri's feeding tube NOT be removed!

WHY? Because it was ALSO his opinion, given all of the FACT, that MS stood to PROFIT financially almost immediately, upon the death of his *wife* terri Schiavo.

The FL Bar board of governors is slowly decending into a deeper and deeper joke.

They continue to be so full of themselves they can not see the trees for the forest.

They told the family law section they can not lobby for homosexual adoptions yet the family law section has and continues to have lobby information on their specific homepage.

For those who do not know, the FL bar has their annual convention this june. Many of those there are going to be judges who have seious cases of black robe fever.

The judiciary is the last bastion for democrats in FL. The problem for conservatives is that the liberals have a numbers game edge on judicial candidates. Liberal law professors will churn out more liberal minded lawyers than conservative lawyers.

actually it is a territory issue not political.

It is the thin black line of us vs them.

The FL Bar is controled by the FL SC. It is judges protecting judges. They do not want their turf challenged.

There is no "greer put them up to this".

All judges and the FL Bar have a reflex action to always defend judges. It is like the MSM always saying good about democrats and bad about republicans.

TERRI......had *NO ATTORNEY* representing her! Judge greer was responsible for making sure that Terri was provided with CONSISTENT legal representation and as a result, he became the ONLY qualifying representative for Terri in court!

Thus.....Greer appointed HIMSELF, as a result of denying terri proper legal representation!

The Bar Assoications are merely Lawyers Unions and should be given no further credence than any other unions.

The only difference between them and the Teamsters or Dockworkers is the latter provide a useful service to the general public.

Attorneys on the other hand are blood-sucking parasites totally as out of control as the Courts and Judges they serve.

Attorneys should all be salaried government employees. Justice shouldn't be for sale to the highest bidder.
