STATEMENT OF KELLY OVERSTREET JOHNSON, PRESIDENT OF THE FLORIDA BAR

TALLAHASSEE -- The tragic and high visibility case of Terri Schiavo has resulted in an unprecedented and unjustified attack upon our judiciary. Regardless of anyone’s personal or political feelings about the Schiavo case, this is a critical time for Americans to recognize the vital role of the judiciary in maintaining the rule of law and the importance of the separation of powers among the three branches of government.

It is in times like these that we should recognize that our judges, on a daily basis and not just in high profile cases, have the duty and responsibility to protect the rights and liberties afforded to all of us by law.

Judges have no control over which cases come before them and they will inevitably be involved in deciding difficult and unpopular cases. When presiding over a case, judges make rulings based solely on the Constitution and other laws, and not their own feelings or personal beliefs.

While we may disagree with decisions and actions of public officials including judges, it is entirely unacceptable and unfair for our judges to be criticized and even vilified when no judicial basis for such criticism exists. Unfortunately that is what is happening as emotions heighten in the Terri Schiavo case.

Florida newspapers are now reporting that Circuit Judge George Greer has not only been accused of murder and terrorism by congressional leaders in Washington, but has received death threats and was pressured to leave his church.

Societal dilemmas should never be confused with constitutional responsibilities. Florida’s legal profession knows from polling that Floridians want nothing less than a fair and impartial judiciary.

Judge Greer is an ideal representative of the type of judge citizens want to hear their case. His rulings are based on laws, not emotions and not politics.

Indeed, his rulings have been repeatedly reviewed and scrutinized by many different courts on many different occasions. We must continue to have confidence in our legal system and expect our judges to act with the knowledge and integrity required of their position.

Judges are limited by duty to responding to such unfair criticism. But Florida’s editorial boards, community leaders and the 75,000-member Florida Bar are not. The Florida Bar joins many of the state’s major newspapers and democratic advocates in denouncing the unwarranted attacks on the judges and courts which serve everyone in this great country.

The National Republican Committee should not be supporting pro-death politicians, and that includes my own NYS, Governor Pataki and Mayor Bloomberg in NYC. Mayor Bloomberg just received a high award from NARAL (or some pro-abortion group).

If the Republican Party is supposed to have a pro-life platform they better stop supporting these people, and my husband and I both told them they won't be getting our money.

We will, however, contribute to politicians like Tom DeLay.

actually some countries (like Japan) have no juries.

Others substitute Notaries for lawyer work. Their notaries are far more significantly trained and important than the USA versions.

Additionally in some countries civil courts do not really exist. It is more a self help issue since there is no real money in their disputes.

As far as florida is concerned,remember many of those lawyers are actually seniors who do not actually practice.

Mayor Bloomberg, whom I just mentioned, was once a Democrat, but became a Republican just to become mayor of NYC.

So why do the Republicans accept such pro-death people. Maybe they need to put principle before winning an election, or they will destroy their party.

If you have an anti-life liberal running against an anti-life liberal, what's the point?

I think the point is to wipe out the democrat party.

If anybody has to be a republican to win an election, then the money for democrats gets dried up as a pointless waste. At least eventually.

Sort of the way nobody wants to invest in buggy whip factories.

It is little consolodation at this point. But once the democrats are sufficiently dead. (not just mostly dead) THEN the Rinos can be further marginalized since their votes will be diluted.

How many GOP appointed judges veer left?

Answer that and you will find that perhaps all college educated people should feel unwelcome in politics and the judiciary. I think we would be better off with ordinary Americans in both branches.

Unfortunately, I think that was a large part as to why this announcement was made! A WARNING to all and to any who DARE to speak out! ????? Why else would this ONE person, speak on behalf of ALL 76,000 members?

Hmmm? I THINK he was served a subpoena requesting Terri's appearance, but I'm not certain. I'll have to check into that!

I got the same feeling.

Judge George Greer does need to be investigated. No matter how one feels about the eugenics movement, he has overstepped his boundaries and denied Terri Schiavo due process. He has been involved in other questionable cases also.

It would not surprise me if it is revealed that he made the death threats against himself. As to being pressured to leave his church, one report alleged that he left because he did not the minister's sermon. Anyway, isn't he involved with Scientology?

The subpoenas also ordered doctors and hospice administrators not to remove her feeding tube and to keep her alive until that investigation is complete. The subpoenas specifically said: "No things, including those things reflecting data, information, or records called for by this request, shall be destroyed, modified, transferred, disconnected, discontinued or otherwise made inaccessible to the Committee." Greer was unmoved..................

Tom Delay caved to Bush pressure. At this juncture I trust Sam Brownback of Kansas and Mike Huckabee of Arkansas. I trust no other Republicans. Governor Huckabee made a statement against Terri being starved to death. Brownback is not a phony. The rest imo are into power and money - they don't really care about judicial reform. That was a ruse to get their base to vote for them. It was just a cheap parlor trick.

I thought bar associations were to police their own for the protection of the public.

Instead they promote their own. They excuse and cover up for their own. they suck up to judges who were once one of their own.

Why do bar associations exist at all except to maneuver for their own monetary gain (Follow The Money Law).

The Florida Bah Association is one of the most corrupt in the country. Ask anyone who reports crooked lawyers to them and never receives an answer, let along satisfaction.
