If nothing else, Ted Nugent isn't going to have to relinquish his "Motor City Madman" nickname any time in the near future.
In a speech given to the National Rifle Association's national convention in Houston, Nugent brandished a pair of assault rifles while urging NRA members to recruit other gun-packing nuts into the gang. He went so far as to urge NRA members not to associate with non-members, and to become "hardcore, radical extrimists."
Siezed by a Second Amendment furor, Nugent then whipped up the crowd condoning shoot-to-kill vigalante justice. The spectacle, urged members to pull their heat and kill a variety of criminals, from child molesters to carjackers.
"No court case. No parole. No early release!" he screamed.
Nugent's disdain for the American judcicial system is a fresh development. March 30, the judicial system awarded him $100 thousand in damages after the Muskegon Summer Celebrataion in Michigan pulled him from its June 2003 bill. Organizers yanked Nugent from the bill after a May 2003 interview on Denver's 103.5 KRFX radio station, when he used a racial slur in a quote attributed to one of the Funk Brothers -- whom were named by Nugent as one of his all time heroes in the interview.
I remember him getting Gloria Alread to STFU once on a Bill Mahr tv show. The dude's good!

Yep, you've identified the hard part. If he has lethal force - and the intent, abililty and opportunity to use it, you're justified. Note that, for instance, if he waves a knife and threatens to kill you from across the room, you're short on the "ability" part. If he rushes you and gets close enough, then you're justified.
IF, big IF, you have no other option - in other words, if you can't boogie to safety, you've got a lot of 'splainin' to do. If you deploy lethal force - and don't use it, you're exposed to "brandishing" laws.
You're also justified, with the same caveats, if you are outnumbered, that's considered facing lethal force.
Chances are if you are in a vicious fight with a stranger and neither of you has lethal force, depending on the local L.E., you BOTH stand a high risk of going to jail after the hospital. And, if you should win decisively, you could quite likely face a civil action from your opponent - and lose.
If you're not in immediate - immediate - danger of serious bodily harm or injury AND you have no other option left but to use lethal force in defense (and you handle the aftermath well and can prove it), you're at great risk for jail time.
If you engage in a consensual fight - it's considered consensual if you don't do everything you possibly can to avoid it, leave, etc. - and you seriously harm the guy, you're at the mercy of the cops and D.A. If you kill him, well, you better have a damn good lawyer.
Exceptions occur in armed robbery - you are in immediate lethal threat, and in defense of home (depending on the state.)
The main point as relates to the article: You can't shoot a fleeing perp or one that does not constitute an immediate threat of serious bodily harm or death.
If you do choose to do this, you had better be prepared for prison.

That works for me. I have alread disassociated myself from my nephew's best friend, who is a pheasant hunting companion that I have hunted with in Kansas for the past 7 years. He sided with my sister when several of my family members decided to challenge me on 2nd Amendment rights and the right to carry handguns......and the right to own .50 cal rifles.
I'm getting pissed off again thinking about it!
Suffice it to say, if we make it out to Kansas again in November, I intend to inform our host of my friend's closet liberal tendencies.....
