Cheney Opposes Retribution Against Schiavo Judges

Vice President Cheney says he opposes revenge against judges for their refusal to prolong the life of the late Terri Schiavo, although he did not criticize House Majority Leader Tom DeLay (R-Tex.) for declaring that they will "answer for their behavior."

Cheney was asked about the issue on Friday by the editorial board of the New York Post. He said twice that he had not seen DeLay's remarks, but the vice president said he would "have problems" with the idea of retribution against the courts. "I don't think that's appropriate," he said. "I may disagree with decisions made by judges in any one particular case. But I don't think there would be much support for the proposition that because a judge hands down a decision we don't like, that somehow we ought to go out -- there's a reason why judges get lifetime appointments."

Actually, the people here are really upset with the proposed legislation to have saved Terri. It would have meant every single living will would have to be rewritten. It would also meant that terminally ill patients who voluntarily give up food and water, after making it known to their familias and physicians, would have a feeding tube inserted when they become unresposive. A lot of seniors were very outspoken about that and thought they had all their affairs in order before this desperate legislation was proposed. That's also why some state republican legislators voted against it - their constituency was objecting. People here really see this as a family matter and don't want the government coming down and interdicting terms.

I don't know what the law is in Florida, but where I come from, matters like this are started by a petition of some sort.

The legal fight over Terri began with the Schindlers filing a petition in Probate court. It was a civil, non-jury matter.

The judges didn't do a de novo review like they were told.

I've explained this too many times now. What do you think Whittemore was supposed to do, and show me where the law said to do it.

If you think it's opinion why not go find the statutes and the judicial canons for Florida and prove it.

For starters, the law for 1-9 said "may," not "shall." It's up to the judge's discretion. I believe Greer has very bad discretion, but that isn't illegal or impeachable, and obviously not enough to be overturned by the appeals courts.

Nice picking and choosing. But I wouldn't expect honest debate from you.

More break downs in the Manifesto, eh? Innuendo, accusations, etc.

You're right, I did pick and choose. It would have been better if I quoted the whole Manifesto. But that's why I gave a link. So people could go and read it for themselves. There's plenty more there. Those in the WPPFF claim to be opposed to namecalling, innuendo, hyperbole, etc., and they supposedly want to avoid emotionally charged words such as Nazi and death cultist, etc. (oops, there I go picking and choosing again!)

Of course, even when people brought up historical comparisons of what took place in Nazi Germany with what occurred to Terri, WPPFFers decried the analogy. Many WPPFFer's took umbrage at the use of the word Nazi. But that was serious. You were, self-admittedly, just being facetious.


Who did I accuse?

Oh, no one, wink-wink. No one at all. Again, you were just being facetious. Yeah, that's it. So, I guess that's okay.

Please, by all means, continue to use the term Nazi death cultist anywhere and everywhere you feel the need.

The United States District Court for the Middle District of Florida SHALL have jurisdiction to hear, determine, and render judgment on a suit or claim by or on behalf of Theresa Marie Schiavo for the alleged violation of any right of Theresa Marie Schiavo under the Constitution or laws of the United States relating to the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain her life.

In such a suit, the District Court SHALL determine de novo any claim of a violation of any right of Theresa Marie Schiavo within the scope of this Act, notwithstanding any prior State court determination and regardless of whether such a claim has previously been raised, considered, or decided in State court proceedings. The District Court SHALL entertain and determine the suit without any delay or abstention in favor of State court proceedings, and regardless of whether remedies available in the State courts have been exhausted.

No, the judges only looked at whether Greer had followed procedure. And none of them looked at the legality of Greer's order of March 8th that Terri should be denied hydration and nutrition by natural means. The appellate judges considering the case after that date were only interested in avoiding the case or in protecting the judicial sphere. Or what they saw as the judicial right to overrule a Governor, a State legislature, and the US Congress' Constitutional right to direct and limit the Federal Courts. Pinellas County police confronted Florida State police and the State police backed down rather than draw their guns on other police. DCF and the Governor are now ruled by the Judiciary. The Florida State Legislature and the US Congress were overruled and ignored by this little man, Greer, and supported by the appeals courts.

There is no need to write law anymore. We should just ask the judges how they intend to rule, since that is the power we will obey, anyway.

I used to say we had a Judicial oligarchy. Now, it's anarchy.

It was a DEATH DECREE against a woman, a disabled woman who knew they were killing her, she cried and was horrified the last fourteen days of her life, got weaker, thirstier but NOBODY COULD EVEN GIVE HER A CHIP OF ICE.

Terri was healthy in need of rehab on March 17th and exterminated by decree on March 31 or was it April Fool's Day THE JUDGES BUMPED HER OFF?

Yes, I hold the Judges accountable.

When Judge Greer can give direct orders to the Pinellas Park PD and the Pinellas County Sheriff to stop Jeb Bush's FDLE from rescuing Terri, I'd like to know how police powers were granted to a swamp probate judge who closes probate files before beneficiaries are contacted. He declares people dead and gives their property away.

NOW HE RUNS THE LOCAL POLICE AND SHERIFF'S OFFICE. How can that be legal?

As opposed to judges who ignore supoenas, Constitutional direction of the Courts, and direct local police to threaten State Police?


While you type your religious bigotry, the courts have turned our Nation against the very principles it was founded on.
