President Bush will make remarks on the death of Terri Schindler (Schiavo) at 11:40 am EST.
Government is a blunt instrument, it doesn't respond immediately to new, unusual, or complicated situations.
If it did it would be more like a dictatorship, all the checks and balances get in each others way at inopportune times.
That being said, we would expect that changes will be made to make sure another innocent is not tortured to death in the name of our government.

Our boys are dying for Arab freedom while our entire political and legal class blithely negates the Fifth Amendment to the Constitution...the very foundation of our liberty...the right to not be killed by your own government.
As Rush as said, if we don't like the laws, change them. That is what needs to happen NOW.

Well, just duck. Red Herring's are easy to spot long before they hit.
That's a huge understatement. It's one of the most corrupt states in the Union throughout its structures. The Governor did ask for federal assistance, indicating his assessment that the State was no longer functional, but the attempt to help from the federal level was ignored. The Executive and the Legislature made no complaint, legal or oral, about that.
Currently not one nominee is blocked by the Senate. We're not at that point in the process yet.
As for recess appointments prior to this Congress, they would all be out of jobs now, as per the Constitution.
Please be more careful to learn something about the confirmation process before attacking the President.
But if you believe in a federal government with limited power, then you really can't fault the President for a "sin of omission" if he did not exceed his authority. The President is not responsible for every wrong in the country and he can't change every dirty diaper.

If you believe that then you should allow them to appoint more judges who hold similar moral views and sense of how the government should act. That is the way forward -- to get OUR life judges in positions of power and remove the death judges. The worst way would be to allow the Democrats to win the next election and have them appoint even more death judges to positions of power.
Yep, for many that is all this is about.

The blame rests with all of us. Me, you and everyone else who did little or nothing to save her. BUT, where is the line drawn? Sure, a team of Freepers or other people could have been thrown together and have successfully stormed the place while eliminating in a most violent fashion, anything that stood in our way... but we have to look at the consequenses of those actions... Now we have to judge ourselves for what has happened individually and as a nation.
A turning point in history has been reached. There is a Judicial power grab at play and we the people must decide how far to let it go. There is fear among the executive and legislative branches of government where the Judiciary is concerned. This is obvious when you look at the actions and lack of action that has occured in the past few weeks.
There is only one solution to this problem that is acceptable at this point in time. Judge Greer must step down from the bench for good. If he doesn't, he must be removed by Congress for conspiracy to commit murder, contempt, and anything else that he can be nailed with. If he is removed violently, nothing will be gained and much may be lost.
The key is that Congress MUST step forward and act to ensure that Greer sees the unintended consequenses of his actions.
As for Terri, we can only blame ourselves. Why? Why didn't we stop this from happening? I know I should have done more. I didn't. I blame myself. I cannot lay blame to the President or to the Gov. of Florida without also blaming myself.

Congress did give the President authority shortly after 9/11.
Words are cheap. The fact is that everyone in power, including the Bush brothers, who had the authority to save Terri from a rogue judge and a demented estranged husband, refused to help her.
In this case you are right. Murder is a crime no matter how many laws allow it, no matter how many majesties in robes say it is "lawful".
Of course they did. It's ludicrous to think that they would have defied the Governor and fired on fellow officers.

It seems our Republican majority in Congress (the ones who change laws) haven't gotten much done. Is Rush saying we need to vote them out of office?
Have you read it? Do you know what an originalist view of "executive power" is? No document or body of legislation can foresee all possible future events and assign a pre-determined path for dealing with them. The executive--in Florida (by their constitution) and the United States, by the U.S. Constitution--is vested with executive power so that action can be taken above, outside, beyond the rule of law when need be. Lincoln exercised it; Truman exercised it. Both were upheld later by the Supreme Court. It exists for a reason. In this case, either executive could have done almost anything he wanted, and the fact both desisted long before exerting their true authority simply means they have bought into a supreme judiciary. Which, I submit, is treating the Constitution like toilet paper.
The execution of court orders is done by the executive branch. No human being can even be executed done without the cooperation of the executive.
In the case of Terri, the police power of the executive branch was used to restain people from feeding and hydrating her--in other words, to enforce the unconstitutional court order. A simple executive order could have put that to an end, Law enforcement is under the command of the governor, and failing that, the Commander in Chief.
the law used to stand for justice, it now stands for power.
