It's the legislature that failed Terri, by not changing the law. But, "we the people" elect the legislature and get the laws that we deserve.

What would stop Jeb from abusing his EXECUTIVE power for other purposes? To seize land, to incarcerate anyone he wants, to usurp the rights of ordinary citizens....
Jeb did what he could, WITHIN the law.

"the supreme executive power shall be vested in a governor." The word supreme means highest in authority. So if he has the Supreme EXECUTIVE power, how does the trump the Supreme JUDICIARY power? Keyes argument is that there is no need for the Florida Supreme Court (I agree that there isn't. They are useless) and that Jeb is the King! It don't wash.

While it's true that there is no higher state-level executive authority than Governor in Florida (and all other states insofar as I know), the Schiavo matter falls under the purview of the judicial, not the executive branch, over which the governor's authority is--if at all like the executive powers enjoyed by the governor in my home state--very specific and very limited. All that can be done on behalf of Terri Schiavo has been done or will be done by Governor Bush. Folks are doing entirely too much feeling and not enough thinking.
Dr. Keyes' case is thus not airtight. He periodically makes statements on the issues of the day for the exposure afforded him. I, for one, wish he would just fade away gracefully, but no such luck.

If the governor tells the local police in Pinellas County to step aside, they must do so, or else be arrested and tried for an assault on the government of the state, which is to say insurrection. True.
Hugh Hewitt said Jeb Bush couldn't or wouldn't do it because the police would have fought back and it is the sort of thing that starts a civil war.

Well, Jeb Bush is courting dereliction of something. Right now he's looking an awful lot like Jimmy Carter did after Operation Desert Helicopter Crash. Jeb said he was going to move in with the DFC. Then he didn't. Then he did, but he didn't send enough force to get the job done. And then he said he'd done all he could. In so doing, Jeb has royally hosed the Republican party, the conservative cause, and himself. Once they got into it, the only way out of this for the GOP was to save Terri, and ultimately show the world that she was not "persistently" vegetative. Had she ever learned to talk again, even at the level of a child, it would have made all Americans stand back and review what the Hell went on there. Instead the media is having a field day explaining to the public that the GOP caved in to the "Christian Right" and fouled up her devoted husband's plan to "allow" the brain-dead Terri Schiavo her "right to die." Yeah, the court system failed miserably here, allowing horribly bad lawyering to result in an innocent woman's death through sheer devotion to "procedure." But doing the right thing was within Jeb's grasp, and he blew it. And he took a lot of us with him. |

True...but utterly beside the point and Dr. Keys should know better. Remember, there are three branches of government, executive, legislative, and judiciary. Each has their duties and obligations under the law specifically spelled out.

So the case is airtight. Why is not Dr. Keyes taking the necessary legal steps to execute the case? Ok, so he's not a citizen of the state. Certainly one of his surrogates or followers is. If the executive has not done it's Constitutional authrority, then impeach the executive or file a citizens suit.
This is just another rant, whether correct or not, by Dr. Keyes to get some attention. I mean c'mon. All this guy can do is talk and write. Where's the beef? It's time in this situation for Dr. Keyes to either crap or get off the John.

Just a couple of questions.
Had Gov.Bush acted on executive authority and removed Terri how long before the lib groups seeing their precious judiciary threatened challenged that action in the Fla.Supreme Court?I think it is safe to say they would rule against the Gov.
If that were ignored by Gov Bush they quickly would appeal to the US Supreme Court.
Of the following six names which two would side with reigning in the court.Souter,Breyer,Ginsburg,Kennedy,Stevens,O`Connor?
At that point,if they found as I suspect they would what happens?What would resolve the stalemate between the executive and judicial branches.
It could add to the strength that the court has assumed for itself as now there would be a Supreme Court ruling to be cited as precedent that they are superior to either legislative or executive branch.
Is there any real chance for a Constitutional amendment being ratified that would restrict the court system?
I believe what is happening in Florida is wrong with dangerous implications for life as well as seperation of powers issues but am unsure what is way to solve the problems.

When Jeb Bush asked the Thomas More Law Center if he had the authority to prevent Terri Schiavo's death in 2003, they agreed with Alan Keyes and stated that he does have the authority. Jeb Bush chose to ignore the center's legal opinion then and he chooses to ignore their reaffirmation of that opinion now.

Jeb Bush gave away his authority as governor to a rogue Circuit Court Judge who has violated Terri's rights as a human being in motion after motion. Judge Greer has refused to consider information that would save Terri's life. He is not following the current law, which states you must have a living will. Instead, he allowed hearsay evidence by the husband-in-name-only and refuses to consider evidence that helps Terri.
