Official Viewed 24,000 Explicit Web Sites At Office

FOND DU LAC, Wis. -- A City of Fond du Lac official being investigated for allegedly viewing pornography on his office computer, viewed some 24,000 explicit sites, some featuring children younger than 10-years-old.

A closed session for council members revealed the information last week.

Council member Michael Schmal said a review of two years of files showed the employee had visited the sites for about four to six hours a day from 2003 to 2004.

Schmal said one of the sites he reviewed was voyeuristic and made him sick.

The city has not yet decided on whether to fire the employee, who was initially disciplined last June.

Fond du Lac police have said the material does not meet the test for criminal prosecution.

WHAT? This guy cruised child porn sites on city time for 4-6 hours each day for the past two years and there's NOTHING there for prosecution? And they can't even DECIDE whether or not to fire him? Our Tax Dollars at work! :(

He could probably claim that he did NOT know that it was illegal to look at porn on company time because no one ever told him as such. He probably thought that "sexual freedom" gave him official cover.

Child Pornography

All states prohibit child pornography. “Child pornography” may encompass either: 1) the creation or reproduction of materials depicting minors engaged in actual or simulated sexual activity (“Sexual Exploitation of Minors”) or 2) the publication or distribution of obscene, indecent, or harmful materials to minors. All such laws require actual knowledge, or reason to know, that the person portrayed or the recipient of the obscene, indecent, or harmful material is a minor. A few states also penalize the distribution, with reckless disregard, of obscene or indecent materials to minors. The states generally provide defenses to the publisher or distributor where some reasonable attempt has been made to discern the age of the recipient of the obscene, indecent, or harmful material.

As noted above, most state statutes reach beyond what is deemed to be “obscene” for adults to prohibit the distribution of material that has been determined to be “harmful to minors,” including that which is indecent or excessively violent. As with obscenity statutes generally, what is “harmful to minors” is to be determined with reference to the local “community.” Note, too, that the definition of a “minor” varies among the states, with most state laws applying to the distribution of harmful material to persons under the age of 18 years but some states prohibiting the distribution of harmful material to those under the age of 17 years.

And his workload allowed him to spend 4 - 6 hours a day cruising the 'net on porn watch rather than doing his job, whatever that was ?

Sounds like the taxpayers need to demand the elimination of that position, as clearly it does not contribute to the general welfare!!
