Schindlers' Options Dwindle to Hearing Tonight with Federal Judge (Motion DENIED)

A federal court hearing has started in one of the last effort attempts by Terri Schiavo's parents to restore their daughter's feeding tube.

But the judge already has turned down the parents once. Bob and Mary Schindler are asking for an emergency order to reinsert the feeding tube in the brain-damaged woman.

The hearing in Tampa is before U.S. District Judge James Whittemore. He turned the Schindlers down once, as did a federal appeals court and the Supreme Court. A state judge, a state appeals court and the Florida Supreme Court also have all come down on the side of the husband, who wants to let his wife die after 15 years in what some doctors call a vegetative state.

The latest defeat for the Schindlers was today when a state judge said he won't go along with Governor Jeb Bush's request to order the feeding tube reinserted. The governor had said that new allegations of abuse of Terri Schiavo need to be investigated. The governor also tried to challenged the diagnosis that Terri Schiavo is in a persistent vegetative state.

George Felos says that Gov Bush has no power to take Terri into protective custody. "They have no more power than you or I or a person walking down the street to say we have the right to take Terri Schiavo.

POTUS can pardon criminals (Clinton did). State Governors can grant stand of execution of jury sentenced criminals. If our President or Governor can not save a life of an innocent person whose only "crime" is that her scumbag "husband" wants her dead, we are no different than Nazi Germany or Soviet Union, or rather we are worse, Hitler or Stalin could pardon anybody anytime if they chosed to. We have become a barbaric nation ruled by tyrans.

I don't understand. What could Terri have put in a will?

The boilerplate language if the Florida Statutes, for preparing an Advance Directive, would result in exactly this result. However, the language is a bit different. It says, in part ...

and if my attending or treating physician and another consulting physician have determined that there is no reasonable medical probability of my recovery from such condition, I direct that life-prolonging procedures be withheld or withdrawn when the application of such procedures would serve only to prolong artificially the process of dying, and that I be permitted to die naturally with only the administration of medication or the performance of any medical procedure deemed necessary to provide me with comfort care or to alleviate pain.

The terms "life prologing procedure" and "be permitted to die naturally" are where I have a problem. Very few people understand the ramifications of those terms of art, to include that "dying naturally" really means "death by starvation."

I think you are wearing pink colored glasses.This is a much more serious crisis then you think. Because this is happening on the watch of a president and a governor who are conservative,and chritian and still it happens.
People who voted for those values last fall will be disenfranchised and the country will become ungovernable in about 10-12 years.
Ther will multiple parties,fragmentation and it will be just like pre war Europe.
It is happening on these threads.

Excerpt of my original post. Her 'loving' husband will sell the rights to a movie and books galore will flock the shelves. If anyone buy them or watches the movie so this man makes money on this they are just as hypotical.

Absolutely not. I will not watch or read anything about this. I am sickened by the entire thing. We are on a very slippery slope that I had no idea was even possible.

Agreed on the terminology they chose to use. Terri *wasn't* dying, until they stopped feeding and hydrating her.

And a lot of Americans teach their daughters that killing a babie - in or out - is okay.

While I can understand your frustration you are going off the deep end - This same type negative rhetoric was said in the 1950, 1960's, 1970's, 1980's and 1990's -

Each decade many proclaim only bad things are sure to come (yet, by more often than not only better times have come on the total).
