Michael Schiavo Files Request With the SCOTUS, USSC Refuses to Take Schiavo Case

Michael Schiavo has filed a petition with the Supreme Court asking them to stay out of the case.

Michael Schiavo living in sin with another woman is morally outrageous, to be sure, but this apparently sways no courts. However, if it's actually ILLEGAL in Florida ...

I am sure it is actually illegal in Florida, and in a few other states.

But when you consider that the legal basis for Greer's decision is based ONLY on upholding Terri's wishes (i.e., spousal relationship to the patient is relevant, but not determinative), there really is no sense in prosecuting Michael on adultery.

my point only is that the many places where I have worked, life support is ventilation.....

if Florida thinks otherwise, so be it....

MY MAIN POINT IS THAT TERRI IS NOT ON A VENTILATOR....

this action by MS is not the same as saying a person is a "DO NOT RESUSCITATE" which in my book is definately okay......

this is killing .....actual killing......

I agree with you. Everyone has the right of refusing or accepting medical treatment based on what is right for them.

But I see a difference between someone in the terminal stages of a disease and someone who has a severe brain injury, yet healthy otherwise.

The argument that tube feeding is extrodinary lifesupport is bogus. Legal, yes. Tube feedings were included in that law because Felos fought for it.

The connections need to be made...not for Terri, but for all of the others who follow her.

Why do you think Felos wanted that in the law? Tube feeding are no big deal. Really. Of all of the tasks I do, that is the easiest. And most of those on tube feedings walk and talk.

If you do not want to have any type of nutrition, that is certainly within your rights. But what about a person such as Terri who cannot speak for herself.

Find a kangaroo court and make sure like-minded persons are appointed to represent that person who cannot speak for themselves.

To end the life of an otherwise healthy person who cannot speak for herself is ripe for murder. I would be interested in knowing how many of these cases Felos has handled. I would love to know how many times the issue of tube feedings was used to help someone who could not speak for themselves to die?

Assisted suicide is illegal. I would guess suicide by proxy is also. This is the way felos made sure assisted suicide is legal in Florida.

Exactly - I've wondered the same thing about why Michael would not want more neurological tests run on Terri. If she is in the state he claims, would they not just give him more evidence to prove his case?

As I have said previously, where in the he!! is the NAG gang??? Where is Amnesty International??? They go after much lesser causes but not this. WHY??? Isn't one of the arguments the AI use is that it "would be the use of cruel and unusual punishment" to side with death penalty opponents. THIS IS CRUEL AND UNUSAUL PUNISHMENT to an individual who's only "crime" was to marry some adulterous POS. Gov. Bush needs to ACT NOW! How can anyone that could have averted what is probably inevitable live with themselves. Death row inmates get more preferential treatment than Terri has gotten. I guess that shows where the "legal" field is slanted. It would be interesting to find out how many reprieves Greer and the other "judges" have issued and to whom. Then put that against how many rulings they have issued AGAINST Terri. It would be telling. If she is to die, I pray that God takes her soon so as not to suffer any more. She doesn't deserve this.

But he will be judged, for all eternity.

And remember, he is innocent until proved guilty. All we have is speculation that he committed/is committing some sort of crime. We may never know but God knows and that's all that matters.

You're trying to blame the law when Judge Greer has repeatedly broken and ignored the law.

Was it G-d's will for you to be left to starve after birth? Or for anyone? G-d's will is that we care for those who can't care for themselves.

Yes, if Jeb refuses to do anything I've spent my last money in Florida. And it was bundle - went to a conservo conclave in Boca Raton. I'll save it to visit honorable places like France!

This is what is confusing, if JB already HAS the executive power and authority to take custody, why would he need to make a request?

Seems he doesn't actually have that authority. I'm sure he is being advised by very good lawyers.

Hope I am wrong about that.

I have a question, for an attorney (and you came to mind). How come DCF can't use this to get around Greer's mandate that Terri not be taken into custody?:

Examples: After petitions were filed with sufficient valid signatures to qualify a proposition for the ballot, the city refuses to call the election, claiming it has a legal opinion that the proposal is unconstitutional. The backers of the proposition file a petition for a writ ordering the city to hold the election. The court will order a hearing on the writ and afterwards either issue the writ or deny the petition. Or a state agency refuses to release public information, a school district charges fees to a student in violation of state law, or a judge will not permit reporters entry at a public trial. All of these can be subject of petitions for a writ of mandamus.
