Michael Schiavo Files Request With the SCOTUS, USSC Refuses to Take Schiavo Case

Michael Schiavo has filed a petition with the Supreme Court asking them to stay out of the case.

I'm not calling for violence but how would Micheal S. death impact the happenings?

The killer would get assigned competent, unbiased legal counsel, and may or may not be given the death penalty. If so, they would be humanely fed and cared for for at least ten years while every possible shred of evidence that he or she might not have done it is painstakingly examined at taxpayers expense. The circumstances of their arrest and the investigation that led to it will be scrutinized to be sure that their civil rights had not been at all violated, even as a technicality... if so, they will be released or given a new trial.

Should appeal after appeal fail, they will be given the chance to say goodbye to their family and then painlessly and quickly put to death.

If Terri had killed someone she would be so much better off today.

Yep. Good tag, too.

We need legislative loopback so that the will of the people through their representatives can be enforced in such a way as to overcome judicial activism.

But it would take an amendment, which would be pretty tough to get through. Maybe this will be the case that will give Americans the mettle to put that amendment through. Judge Bork suggests this, albeit without much hope of it passing, in Coercing Virtue.

Sorry, that doesn't wash. The courts have gotten involved in the legislative process AND in THIS case. How are we to remedy that?

Should Michael Schiavo be arrested on conspiracy to murder and have his guardianship immediately revoked?

Time is running out. Schiavo will most likely be arrested..why wait til after Terri dies..why not now and remove guardianship. The media needs to push for his arrest on the evidence that is now appearing. Why was not closer attention given to this case..on the evidence out there in the last year! Has the much of the media been negligent on reporting this case "with new eyes" before it was and I hate to use the word "was" too late.

Bloggers have been reporting on this case and correlating evidence for some time now...! ....should Gov. Bush's next step be an arrest warrant?

There are also affidavits by a number of people as to physical threats by Michael Schiavo including his stalking of the first girlfriend he had after the attempted to murder Terri.

There is also a sworn affidavit from a nurse from 1996 that Michael attempted to murder Terri five times in a nursing home by injecting Terri with straight insulin. When the nurse went to the local police, she was fired the next day. This affidavit has been around for awhile and the nurse was on the Hannity radio and TV program yesterday.

"About a year and a half ago, I worked two 40 hour wknds(!) up all night in the offices of the (former) lawyer for Terri's parents. I was able to read most of the files on the case. I was there when two former nurses phoned (separately and entirely of their own volition)and asked to come in and give an affidavit about what they knew. They said they could no longer keep silent, though for years they were so intimidated by Michael Schiavo, they were afraid to speak up. I was there when each of them, on their own, arrived in the garage of the office building. Both of them looked around to make sure they were not being followed! Both of them described hideous behavior over the years by Michael Schiavo. They described his phone calls (especially when she had an infection and he forbade antibiotics) asking the nurses "Is the bitch dead yet?" and his boasting of how he was going to spend the money he would get after her death. Weeks would go by when he would not visit at all. Once he received the million dollar settlement, he forbade Terri being taken outside in a wheelchair for change of scenery and fresh air. He forbade music on her radio. He had her personal effects removed from the room - all visual stimuli. Her parents and siblings were not allowed to visit her and could not read her chart. One of the nurses talked about his visits to Terri when he closed the door and was alone with her. When that nurse entered the room after he left, she found Terri shaken, trembling and pale and looking as if she was in a diabetic crisis. Terri has no blood sugar problems due to her regulated diet, but seeing her distress and the appearance of diabetic crisis, the nurse gave her a glucose test anyway and the numbers were so skewed that it was clear Terri was in insulin shock. The nurse gave her a shot to alleviate the diabetic shock and immediately suspected Michael had injected her during his visit to cause this. I believe she said this happened at least twice. The nurses also described taking care of Terri and how when she had menstrual cramps she would curl up and put her hands on her tummy (she was able to move them in those early days before the atrophy progressed due to Michael forbidding therapy)and clearly say "Pain!" or "Pain!" and call for her mother...More.... Good morning.

Judges, especially activist judges, interpret what the law says and rule according to their personal bias. The SC justices didn't rule, they just refused to hear the case. All other black robes involved have based their decisions on Judge Greer's rulings

If you don't see that you need to change your FR name.

I agree. I was shocked when I heard some of the parents' pleadings. Correct me if I'm wrong, but I believe I heard a reporter on Fox say the pleadings failed to call for an immediate reinsertion of the feeding tube to allow time for a de neuvo review. I also believe he said they failed to specifically request the de neuvo review. Did anyone else hear this report on FOX last night? I want to make sure I heard it correctly, because it's hard to believe.


Good grief, the appellants have to at least ask for this stuff! They failed to hire an experienced appellate lawyer, and as far as the reporter knew, they were not planning to hire someone with experience at the Supreme Court level. Some of the trial pleadings argue faulty theological points as though they were law, especially centering on Terri's future stay in purgatory, instead of arguing Terri's Constitutional Right to practice her religion.

Were I in the parents' position, I would hire a new legal team and explore the possibility that Terri failed to get adequate legal representation.

I just heard Judge Bork on Fox News being interviewed about the USSC turning down Terri's case. He said that this is happening in thousands of hospitals daily where babies are born with Downs Syndrome and failed abortions where the babies are born alive. He stated they are left in the hospital with no food or water until they die. My God where are we in this country?

Yep, looks like we failed Ben Franklin's challenge. It's not irreversible, but apparently the measures required to recover what was ours cannot be discussed, even in this forum.

What are the impeachment proceeding particulars for the State of Florida for the Governor?

Would he survive an Impeachment vote in the House?

Would he be convicted in the Senate (or removed from office)?

AT THE END OF THE DAY, what's stopping Governor Bush from overthrowing GOVERNOR GREER at this moment?

I don't think the Dems or RINOs could do anything in the aftermath. A girl's life hangs in the balance. She could die this AFTERNOON.

Yes, Florida law should state its wrong to hold food from hungry and water from thirsty. However, its hardly an emotional reaction to be shocked when its discovered that Florida law requires some people to be starved and dehydrated.

But Terri is not a tug of war rope for this issue. Let the poor woman go to meet her maker, at least she'll be in peace.

Do I agree with starving her to death.... HECK NO.

Do I think that there is more to this case than meets the eye... YES.

Do I want to keep removing/inserting a tube into this woman's throat so that we can feel better about ourselves... NO!

God will take care of Terri and judge the rest of us for our actions. If Michael had something to do with her condition, he will face judgment for it and his suffering will be worse than Terri's.

The laws enacted by the legislature is what at the core of this mess, those laws are still standing, and in effect.

The legislature has no legal basis to do what they've tried to do.
