Appeal For Schiavo is Filed At Supreme Court by Parents

TAMPA, Fla. (AP) A lawyer for Terri Schiavo's parents says an appeal to try to keep the brain-damaged woman alive has been filed with the U.S. Supreme Court.

Perhaps I am just a might bit lax on judicial proceedings, however shouldn't a living human being have the benefit of doubt and have access to sustenance until a decision is achieved?

The SC is the last stop. She will die because the SC will not grant a stay and Gov. Bush will not "rescue" her. When she is dead we had better get busy changing the judicial system or we will end up exactly like Nazi Germany. We're not too far from it now.

Problem is nobody will roll in and rescue Terri, there is even an order against Family Services getting involved as well.

They want this woman dead with lots of passion.

Does the DCF need a parents permission before going in and dragging a scared kid out of the house based on some specious charge of so-called 'child abuse' ? Permission has NEVER been an issue in thousands of cases like that !

Yes, I read it. But, there isn't time to have his court ordered guardianship overturned.

Unless, of course, the danger to the victim is the guardian. Same story as with a parent accused of abuse.

If he consults the full court, Terri dies. There is no time for consultation. If I'm not mistaken, the tube could be re-inserted now if Kennedy so chooses, right??

That would be my belief, but apparently no injunction was issued to keep her fed until the appeal process occurred...

I have no clue why...

What if that legal guardian is abusing the person they want to protect? If they had the ba*** they would go in.

I have to agree with you on that.

SCOTUS has declined to get involved before, and I'd expect that they'll do the same this time (political, spineless weasels that they are).

DCF needs to go in and get her. Sort out the mess once she's safe. (Apparently, Florida law allows this. It's time for Jeb and the DCF to ACT!)

Can't be -- the parent is legal guardian of a child and they can sure take the child away if there is abuse. They may well need court permission first, but in an emergency situation, they can pull the child and then go get permission. The restraining order is a complication, though.

Personally, I'd like to see Michael Schiavo in a "persistent vegetative state", see if he thinks starving to death is as peaceful and painless as he claims.

If they act under the orders of the Chief Executive (the Governor) they cannot be touched. At least it is that way here in Oklahoma.

The Bush brothers have done everything they could and tried every ave. There is no other roads to use. People have to make sense here. There is not going to be a rush of troopers or national guard troops. It is not going to happen.

The lessons from this case which has been going on for years and years and all of a sudden in the last few months has gotten this massive attention are:

Have a living will
Pay attention to the judges during election time and vote the bastards out
Never marry someone who would want you dead under any and all circumstances


Get ready to watch the movie and book deals for Michael.

The only hope Terri's family has is that the Supremes issue a temporary order replacing the feeding tube. Sadly, I think it will be removed again if it is reinserted.

On a related topic, it is beginning to appear that the Schindler lawyer is completely incompetent.
