Tonight it is, March 22, 2005, over five days since Theresa Marie Schiavo commenced her ordeal of purposeful and legally sanctioned dehydration and starvation. We await a decision from the three judge panel from Eleventh Judicial Circuit as to her fate, as her family struggles with seeing Terri's physical health deteriorate.

Can't you imagine the HORROR that Michael would feel if Terri was given the best rehab and regained her speech!! Not only what happened to her that awful night, but that SHE NEVER SAID ANYTHING TO HIM ABOUT TAKING HER OFF FEEDING TUBES, ETC.!!! Can you imagine what would happen? No wonder he is frantic to be sure she dies!!

I have to get up early. Ya'll hold the fort. I dont know what to feel right now except that it is in God's hand and the 11th circuit. I trust the former and hope the latter rises above being lawyerly nad acts human.

Personally, I'd take my chances and let the baby live and leave that decision up to God. I don't think it's our place to decide which human life should be snuffed and which should be saved. Those three children could also be deprived of their mother if the mother got into a car accident or something similar. Taking a child's life is never acceptable.

I would not fault a mother who decided that. On the other hand, I would not condemn a woman who decided not to give up her life for her unborn child, especially if she had other children. Even if morality would demand that the mother be willing to give up her life for her child, morality does not give anyone else right right to force that choice upon her.

The president can write an executive order to get Terri into a hospital immediately. It is not breaking any law to do so. The judge can still take time to ruminate over this case. This action would not interfere with the judge. And since Greer already flaunted a Congressional subpoena his ruling is highly questionable.

Executive orders are lawful. They've been written by presidents ever since Washington on a number of different issues.

Contacting the president and ask him to write an executive order immediately. If you cannot reach him, then contact your state senators and representatives.

The "Unless you fit our mold of what is quality life", we can now starve you to death crowd, probably thinks that once Terri dies, this will all go away and it would have, if they did not take the feeding tube away. We would have went on our merry way not realizing what our future would entail. Fortunately, they still have not learned their lesson from 9/11 and God is now blessing this Country.

In part to these death worshipers, the Right to Life now have a viable "face" to our cause. Very bad judgment on their part. All they had to do was allow Terri's family to care for her at home. We would have never known what hit us when the DNR(s) started going into action. They would have gotten away with it just like they did abortion for all of those years.

I have to admit my eyes have really been opened to our enemies now. They have very ignorantly I may say shown their hands alittle too soon. I honestly did not think our Society had sunk so low that even here at Free Republic, there would be numerous "debates" as to what qualifies for the right to live and what doesn't. When we can take the defenseless and starve them to death without a twinkle of remorse, I now understand how the unborn must feel. As a parent, I can not fathom how anyone with any soul or even alittle bit of a heart, can stand and watch while another innocent human being is being starved to death because society has deemed this life no longer viable. What could have possibility been done to them to be so clinical and unfeeling. They say the problem with liberals are they think with their hearts. We now know this is untrue because they have no hearts. Welcome to it takes a village to kill you.

Probably like this ... "Out of control religious zealots try to take the law in their own hands ... we a re a country of law and order; not vigilantly justice ... and they had to be stopped or we would be welcoming anarchy or some crap like that.

For sure you would be labeled a DENSE, religious zealot who wants to keep a "vegetable" alive and had to be stopped. They'd certainly justify their killing the family trying to save Terri. Look how the media is lying about her condition - "vegetative state" with NO hope of recovery. The main stream media favors her death, hence the massive misinformation. I think they get off on deceiving people.

I will not state he isn't a good man, but there are others with more experience and the name recognition to command respect from the Judiciary. The last is especially important, it's the dirty little secret not openly acknowledged.

Schindler's lawyer, David Gibbs, may have fatally erred by dragging the previous court case into federal court as the basis for the stay...Whittmore had to respond to what was presented to him, and Gibbs presented nothing new.

Gibbs did not have to present anything new. The law required that Whittmore try the case de novo. It does not mean new factual allegations. It means a new hearing to hear all of the evidence. The previous court case was relevant, because, if the allegations are true, then it is part of the pattern of violations of Terri's civil rights.

The error that Whittmore made, and that his sympathisers are repeating is a circular argument - presuming that since Gibbs argued nothing new, the case had already been decided. But, if the law requires that the case be retried, then Whittmore cannot base his decision on the findings of fact of the previous court hearing.

The error is a transparent logical error (question begging) and I am surprisde that any experience jurist would commit it or fall for it.

Gibbs brought it into the new pleadings

Gibbs should have copied and pasted the old pleadings as it were. That is what de novo is all about. Gibbs had stale pleadings based on something other than de novo.

This de novo matter may raise its own consitutional issues. I don't know. Having two bites out of the apple in a civil case, is well, rather novel. But that is not relevant to an injunction motion.
