Yes, but I think it was only done symbolically. I think that's what I heard, but I may be wrong. I believe they wouldn't be able to get close enough.

I'm not going to flame you, and I don't think that there is some nefarious plot by the judiciary to kill Terri. What I think happened is that Judge Greer made a mistake when he accepted Michael Schiavo's word that Terri would want to die. He was living with another woman which is an obvious conflict of interest. Every decision made since then has been based on Greer's judgement. As I said before, I don't think that the courts are intent on killing her, but I do think that they are more concerned about procedure than they are about the actual merits of the case.

I notice all the stations are working hard to make michael look like a nice guy.

Yet the radio talk shows are all taking the oppositve approach. Laura Ingraham considers Michael a monster and murderer. It's amazing what polarization this situation has caused.

For example, Dr. Hammesfahr's testimony because of a techicality that he didn't bring paper documents substantiating his successes in treating similar patients. I also think that he didn't allow various affidavits filed by nurses supporting the Schindlers and by an ex-girlfriend that stated that Michael admitted never discussing the issue of End-Of-Life decisions with Terri. I also think that he dis-allowed testimony from a friend on Terri that said that Terri did not agree with the decision to end life support for Karen Ann Quinlan.

I know RWJ is left oriented but I didn't know there was a connection here.

I suspect, I don't know for sure, that they are probably heavily involved in embryonic stem cell research. It is FEDERAL funding that is banned. A private institution CAN legally pursue it. I see NO reason why they aren't pursuing it. Most of the left sees "great promise" in this plus it suits their culture of death to the unborn mentality.

I am sooo sickened by this Terri situation.

Surely our Good Lord must hear our heart cries and prayers to Him and know that some of us still SEE and WANT to adhere to His teachings - thou shalt not MURDER! I was hoping that if enough prayed to Him, that this would stop and that our country would straighten out. I fear there is not enough of us to have that happen. I fear we just made another evil milestone. I see this as a grave moment on the slippery slope - as in abortion - not it is the brain damaged.

A government that allows an innocent woman to starve to death, is by definition immoral and illegitimate.

Allowing someone to starve is one thing...Forcing one to starve is quite another...

It is clear that Whittemore did not even attempt to follow the intent of the new law, and he committed a reversible error, as his opinion seems to defer to the Greer findings.

He's not allowed to do that. The whole point of the law was to make Greer's findings NOT determinative. In assuming that the Schindlers would not prevail in a new federal venue, this judge has implied that he believes no other facts will help Terri. He's advocating for Greer, in effect.

This is WRONG. His opinion should be quickly reversed.

Of course, I am speaking as a layman, not a lawyer.

I seriously doubt that the 11th Circuit would order the district court to go to the merits of this case.

Really, at this point, the appeal focuses solely on whether there was an abuse of discretion on the part of the district judge.

Unfortunately, there is little hope here because while Congress made a courageous effort to get this matter into federal court, the language of the legislation was such that court was given wide latitude in this matter.

From a legal perspective, the only kind of legislation that would have brought about a truly just result would have been a bill mandating a de novo review in federal district court.

Unfortunately, this federal judge did not allow a de novo review. Without such review, federal judges will usually allow a state court ruling to stand...absent some clear abuse of discretion.

The factual record....in state court...was stacked against Terri...for whatever reason.

It is very unfortunate. And, my heart goes out to her family.

Politically and legally...there will be hell to pay because the American people demand to know the truth here.

I am in agreement with you on this. There should be an investigation. Perhaps, the parents can ask for an autopsy. Such an autopsy would reveal whether there were broken bones consistent with abuse.

Terri's "husband" has already succeeded in getting a ruling from Judge Greer that she is to be cremated immediately- no autopsy. It seems the world has gone mad!

Sort of. They look at the trial record. Naturally, that is a view of the evidence allowed, but also, if evidence was WRONGLY EXCLUDED, the trial result can be overturned. See also, e.g., bringing DNA evidence into old cases to exonerate convicted criminals.
