Here is a what if to consider:

What if the 11th circuit refuses to hear the appeal.

Hey! We'll have none of that "Following the Law" and "Respecting the Constitution" around here! Remember, we don't like activist judges around here only if they don't rule OUR way. In this case, who cares about the law?

As was said previously, Mrs. Schiavo is a Sainte, and what she would want doesn't matter--all that matters is keeping her body alive!

I think we are on the same wavelength here. ;-)

The judge is saying that the Schindlers wouldn't prevail at a de novo hearing.

My God, especially in light of Greer's conflict of interest so early on, not to mention so many other things, how the heck can Whittemore say that?

Excellent Post,

I believe the execution of a true innocent is symbolic of this country's rejection of God. If the politicians and lawyers can't save her, then IMHO we are doomed as a nation that turned away from God and we will face His judgment.

I pray for Terri and my fallen country,
F H

The worse news, after the 11th Circuit Court rules, the final jury, SCOTUS has refused to hear the Schindler's appeals three times already.

You death lovers always have to resort to lies to support your morally bankrupt position.

Which part of the 8th and/or 14th Amendments did you not understand?

Some FReepers are coming out of the woodwork cheering this decision. "Sorry that's she's dying and all, but praise be the Constitution is saved! States rights are alive and well!'

Guess what, you fools. You haven't won anything. The Constitution and the courts are in as bad shape as ever. They've just used your own respect for law against you. They'll be back tomorrow pushing the Bill of Rights through the shredder as always. They got what they want by pretending to give you what you want.

"The devil can quote scripture for his own purpose" but that doesn't mean he's converted. To think that activist judges and liberal politicians have changed their spots overnight and become strict Constitutionalists is fantasy. I'm sorry to see so many FReepers indulge in it.

this is expected - this judge gave notice of his decision as soon as he scheduled his hearing for 3PM yesterday.

Bring back Janet Reno to take Terry by force. A child belongs with his/her parents, right (Elian?)

The next stop is the 11th circuit in Atlanta.

Hopefully, the 11th Circuit is out from under the influence of the Scientology cult in Clearwater. Damn this judge.

No, I think the 11th circuit would hear this on an expidited basis. But they can deny the appeal. Then it'd go up to the US supremes.

Life trumps "State's rights." The State actually has no rights independent of the individual, inalienable rights of the people.

The people of Florida, by the actions of their Legislature and Governor, have expressed a desire to save this woman's life. The Judicial Branch has over ruled the other 2 branches.

It's not as if the Constitution supports a system where the big, important questions can only be determined by the courts, leaving unimportant ones to the Legislative and Executive branches.

And this ruling respects Terri's wishes. Good call, judge.

Thank you George Felos. By the way, how do YOU know what Terri's 'wishes' really are? Oh that's right, because Michael Schiavo 'remembered' what they were SEVEN YEARS AFTER HER (ahem) 'accident', right AFTER he got 'engaged' to his current live-in lover.

'Good call' my azz.

" this judge gave notice of his decision as soon as he scheduled his hearing for 3PM yesterday."

How did he do this? I missed it.

Non-action is death for Terri Schiavo.

Maybe we are also guilty of non-actin for allowing it to get to this point.

If Terri does die, it may energize America even more than in the 2004 election, which was a horrible defeat for the liberals.

I don't want Terri to die, but she might one day be smiling from heaven if she sees a number of good US Senators replacing Culture of Death Senators and Good Judges replacing those so firmly in the grip of the Culture of Death and of Satan.

I so agree with you. This should be a sober and somber day for those of us who respect life.
