WASHINGTON, March 18 /U.S. Newswire/ -- House Majority Leader Tom DeLay (R-Texas) today delivered the following remarks at a press availability on the House of Representatives' efforts to save the life of Terri Schiavo:

"It is now one o'clock on the East Coast, the time preordained by a Florida state judge to allow for denial of food and water to Terri Schiavo. This act of barbarism can be, and must be, prevented. The Senate has before it the Protection of Incapacitated Persons Act of 2005. This bill is the right thing to do. Unfortunately, they have chosen to adjourn rather than pass it.

"Those senators responsible for blocking the bill yesterday afternoon, Senators Boxer, Wyden, and Levin, have put Mrs. Schiavo's life at risk to prove a point - an unprecedented profile in cowardice. The American people are not interested in squabbles between Republicans and Democrats, or between the House and Senate. They care, and we care, about saving Terri Schiavo's life. The House bill will do that.

"Terri Schiavo is alive. She is not 'barely alive.' She is not 'being kept alive.' She is as alive as you or I, and as such we have a moral obligation to protect and defend her from the fate premeditated by the Florida courts. This is not over. We are still working, so are Mrs. Schiavo's lawyers, and so is the Florida state legislature. This is not over.

I hope they still subpoena her. She needs no machine to live. It would point out that she is starving to death. Show her every day she has her feeding tube out.

What I want to know is, why are they appealing the Texas judge, instead of sending a US marshall to the hospice to protect their witness? A Fla. Superior Ct. judge has no authority to kill a witness in a congressional inquiry.

What am I missing here? Don't the Republicans have an absolute majority in the house and a narrow majority in the Senate, but still a majority? Why do Democrats matter?

US Marshall's are not controlled by the Legislative or Executive Branch of the US Government. They are controlled by the Judicial Branch.

That doesn't make sense. Wouldn't they be an arm of the Justice Department. I am against the court having it's own army to enforce it's rulings. That is for the executive power to carry out.

Thanks for picking that nit. There are federal law enforcement officials that can be used to enforce congressional subpoenas. It it's not marshalls, it's someone else. They don't send their Capitol Police out there when they have to enforce a subpoena. So, whichever agency is used, they should send that one to Florida.

Actually, you are correct.. US Marshall's are appointed by the President and/or the US Attorney General's Office. They are there to work for the Judicial Branch.. There are only 95 US Marshall's in the United States.
