No, they are not controlled by the Judicial Branch. U.S. Marshals (not the deputies) are appointed by the President and subject to Senate confirmation. The Marshal's Service hires Court Security Officers to provide security for U.S. courthouses, Deputy U.S. Marshals are responsible for fugitive apprehension, for administering the Witness Security program (part of it) and for delivering and transporting federal prisoners. However, the U.S. Marshals Service is a component of the U.S. Department of Justice, which is part of the Executive Branch.

Isn't the state judge in contempt of Congress, by ignoring its subpoena and the order contained therein? (OK, no jokes about contempt of congress, this is serious). Shouldn't a federal judge have jurisdiction of that contempt order, which is a violation of federal law?

Your definition, not mine. The famous, county by county, Red/Blue map of the 2004 presidential vote breakdown closely approximates the much broader meaning of and sense in which I use the term. And if it makes heavy left, PC coneheads go into the vapors when they hear it, why that is just a freebie.

Unfortunately, no. Contempt of Congress is not the same as contempt of court. I'm waiting to see how far Congress is willing to push this confrontation. I'd like nothing more than to see congress subpoena Judge Greer and for a U.S. Marshal show up at his house, place him under arrest, and escort him to Capitol Hill. That's one media event I would watch.

Rush talked about the wider implications in this case. My guess is that we could balance the federal budget if we applied the principles to nursing home residents. I heard recently there are 6 million people in nursing homes. Any one else care to estimate what we are paying in Social Security, Medicare and Medicaid to keep incompetent people alive?

That's absolutely true. And, in many cases, the residents of nursing homes signed over all of their assets to the nursing homes before they were admitted. I'm hoping your point is not the same as the [unstated] opinion of many Democrats: that we could ease the burden on the health care system and the federal budget by allowing this order (and the number that are likely to follow) to stand.

Far be it for me to suggest anyone break the law but, what if a bunch of us who believe murder by starvation is somehow "wrong" (silly us, I guess) simply stormed the hospital, and kidnapped the poor woman. Take her to a private hospital where she can get the care her (murderer) husband has denied her for 15 years?

It's not lady like, but BS! This is NOT a States Rights issue. The federal gov. is charged with just a very few things and one of those is protecting the lives of its citizenry.

I used to live in Delay's district, worked the polls there, was a member of a local republican woman's group, and it is a place where people understand right and wrong. There have been times I've been angry with him (get mad at all of the pols on some issues) but today I am right proud of him.

My recollection is that contempt of Congress consists in failing to show up, or failing to answer questions without asserting a valid privilege, or failing to produce documents or things. If Congress can order the production of a person or a thing, it would be logical to assume that they can order that the person be kept alive and that the thing be preserved. Wouldn't removal of a feeding tube from a person who is the subject of a valid congressional subpoena constitute an effort to destroy evidence and thus constitute contempt of Congress? Or have you some knowledge of the statute that provides otherwise?

I actually was thinking the same thing... "This has shown up everywhere..." However, it brought a tear to my eye this morning when I first read it.

I don't think it is being done maliciously, I just really think that there are so many who come to this forum that feel almost entrenched into this story, because it goes much further and branches into so many corrupt directions. I firmly believe that "spam" threads violate teh rules... I guess I just see this post as something necessary for many to see, not a "spam thread", that's all.
