WASHINGTON, March 18 /U.S. Newswire/ -- House Majority Leader Tom DeLay (R-Texas) today delivered the following remarks at a press availability on the House of Representatives' efforts to save the life of Terri Schiavo:

"It is now one o'clock on the East Coast, the time preordained by a Florida state judge to allow for denial of food and water to Terri Schiavo. This act of barbarism can be, and must be, prevented. The Senate has before it the Protection of Incapacitated Persons Act of 2005. This bill is the right thing to do. Unfortunately, they have chosen to adjourn rather than pass it.

"Those senators responsible for blocking the bill yesterday afternoon, Senators Boxer, Wyden, and Levin, have put Mrs. Schiavo's life at risk to prove a point - an unprecedented profile in cowardice. The American people are not interested in squabbles between Republicans and Democrats, or between the House and Senate. They care, and we care, about saving Terri Schiavo's life. The House bill will do that.

"Terri Schiavo is alive. She is not 'barely alive.' She is not 'being kept alive.' She is as alive as you or I, and as such we have a moral obligation to protect and defend her from the fate premeditated by the Florida courts. This is not over. We are still working, so are Mrs. Schiavo's lawyers, and so is the Florida state legislature. This is not over.

"To friends, family, and millions of people praying around the world this Palm Sunday weekend: do not be afraid. Terri Schiavo will not be forsaken."

I'm too lazy to go back and get the posts of all the "conservatives" demanding that the federal government NOT get involved in the Alabama 10 commandments case. Demanding the state judge not fold. Demanding that the state was sovereign and the feds had no jurisdiction....

Thanks for the info. I was worried there for a minute. I don't want the judicial branch having its own teeth. Dangerous. Here in Massachusetts we experienced what could happen when Governor Hutchinson was also the Chief Justice.

If they (Congress, the White House, various Florida Republican officials, etc.) put as much effort into doing something about abortion, as they have with trying to save this one woman, one wonders how many lives could be saved every day....

Unlike the situation where the Constitution lets states do things like establish a religion (see, e.g., Maryland until about 1830 or South Carolina til about 1850), the Constitution, through the 14th amendment gives the federal government a role in the protection of the life of citizens. Not as far as the libs would like to take it, but there is a long standing practice of use of the writ of habeas corpus to protect the life of convicted criminals, and as long as they get to use the writ, it seems to me that it could be used to protect the life of an innocent non-criminal, too. The Feds have some legitimate interest in this case.

The Feds vastly expanded the scope of their purview in the Roosevelt years through a misinterpretation of the "necessary and proper" clause of the enumerated powers of Congress, and through misuse of the interstate commerce clause to include anything that might indirectly impact interstate commerce (which everything does). The protection of the 14th amendment which extends to the lives of US citizens well predates that expansion.
