Dear Concerned Citizen,
Thank you for writing to me regarding HB 701 and Terry Schaivo. I voted against the bill for several reasons. Because there was a lack of communication with experts in the fields of medicine, law, and ethics on the creation of this bill I tried to pull in information for several different resources. One of those resources was the University of Miami. According to the University of Miami Ethics Program, HB 701 has problems on several fronts, some of which are listed below:
In 1999, the Legislature created a Panel for the Study of End-of-Life Care. This bipartisan, interfaith panel held town meetings around the state and took testimony and expert advice from a broad range of Floridians. As a result of this process, Florida Statute 765 was changed in a number of ways that were regarded as positive. This set the standard for revisions of statute in this complex area. HB 701 appears to embody little such caution, process and community and expert input.
The bill would impose impossible burdens on physicians and patient surrogates, proxies and guardians. It would do this by establishing a standard for refusal of treatment that cannot in many circumstances be met. Paradoxically, it could lead to patients not receiving artificial hydration and nutrition when it might provide temporary help -- out of fear that once it is started it will not be possible under statute to stop it.
The bill would establish insurmountable barriers to Floridians' exercise of uncontroversial rights to refuse burdensome medical treatment. That is, it has been settled in medicine, law, ethics and most faith traditions that the right to refuse treatment is essential to the full exercise of autonomy. HB 701 undermines that process.
The measure misjudges the medical nature of artificial nutrition and hydration and the ethical issues involved in withholding and withdrawing such interventions. Even if HB 701 were somehow correct, it would prove too much. Why stop at medically provided artificial hydration and nutrition? Why not include ventilator support, dialysis or any other medical procedure or intervention?
This tragic incident should make all of us to be more careful and vigilant in letting our true wishes be known to our family members in cases such as this.I believe the state should not be involved in solving family problems and I wish her parents and husband could come to an agreement. Any action taken by the state will have far reaching effects upon every Floridian.

This does not include the goodness I feel eminating from Free Republic, FReepers, and everyone else who supports Terri.
The evil I feel is from people who live in this state who have refused to acknowledge what is going on.
Next time it will be them.
They should have gotten on the air and blasted this process. I am sickened that they did not take this opportunity to tell the world just how sick this process is. Why on earth would they cancel it.
