COLMES: I just had the privilege of seeing you speak on the Senate floor. And you spoke about freedom. And you spoke about dissent. And you spoke about the importance of the minority to be heard. What does that mean in the context of today's Democratic Party versus the Republican Party, and how the parties are interacting in today's Senate?
BYRD: There's nothing partisan about this subject. When you talk about the "nuclear" option, they're really talking about the freedom to dissent, freedom of speech in the Senate, freedom to debate. They are speaking for the minority. That's what the Senate is about.
It's the last bastion of minority rights, where a minority can be heard, where a minority can stand on its feet, one individual if necessary, and speak until he falls into the dust. And the president is all wrong when he maintains that a nominee should have an up-or-down vote. The Constitution doesn't say that. The Constitution doesn't say that that nominee shall have any vote at all. There doesn't have to even be a vote.
COLMES: You quoted historian Alan Bullock who wrote about Hitler's dictatorship resting on the foundation of a single law, the enabling act. The Republicans kind of went crazy and said, oh, you compared Bush to Hitler, you compared him to the Nazis, you invoked Hitler on the floor of the Senate. What did they misunderstand about that?
BYRD: I invoked history. I was putting it as a historian. What is this all about? I pay no attention to the flies, the gnats, the little bug bites. I keep my eyes on the ball. This is about freedom of speech.

Can you imagine the outcry from the naacp, calypso louie, the black caucus or any of the race pimps if Senator Santorum had said that. According to alan colmes, the word now means ignorance. Wow, these hypocrites, I can't even begin to state my disgust.

I have never understood why the Senate hasnt forced them to do exactly this. Why dont they close the doors and not even allow them out to take a leak until they have spoken their piece. This filibuster we have going now is a boatload of crap. Make them really filibuster with no breaks.

It is not that the GOP leadership has no spline (a comment seen from many FRers on this topic), it is why they have no spline!
The short version: Under current US Senate rules, a "real" filibuster would require that 51 Republicans be present at all times, but only ONE Democrat (the one doing the talking) on the Senate floor. The other Democrats could be home asleep in their beds. The reason for the 51 Repulicans is that the quorum requirment is that a majority of the elected body to be present to conduct business.
The reason is the the current rule state that a filbuster may be stopped by 'cloture' when there are three-fifths of all ELECTED Senators (that would be 60) agree to stop debate. At various times in the past the Senate "cloture" rule had two-thirds of all Senators PRESENT on the Senate floor as the way to stop a filibuster. This older rule would be the one which would require a substantial number of Democrats to be present to prevent the Republicans from voting for and getting cloture. If the Republicans had all 55 members present under a "three-fifths PRESENT and voting" rule, then the Democrats would have to have 37 members on the floor to sustain the filibuster they were conducting.
This is the way that the "Mr. Smith goes to Washington" filbusters with the Senate filled with Senators worked. Under the current 'cloture' rules Claude Raines would be out drinking...
