A North Bellport resident surprised an armed burglar who tried to break into his home, when he grabbed a shotgun and fired at the man, hitting him in the shoulder, Suffolk police said.
Cheyenne Ray, 44, was alerted by his girlfriend, Tanya Rivera, 31, that she heard a noise at the front door about 1:30 a.m., said Fifth Squad Det. Sgt. Kenneth Hamilton. Ray looked through the glass storm door and saw a hand holding a 9-mm pistol strike the glass. Ray went into the kitchen, got a shotgun, and fired one shot at the door, Hamilton said. The burglar dropped the gun and ran off, Hamilton said.
The alleged burglar, Marion Gillard, 23, of Bay Shore, was later spotted in the area with a gunshot wound in his shoulder and was arrested by police. He was taken to Brookhaven Memorial Hospital Medical Center before being transferred to Stony Brook University Hospital where he was being evaluated yesterday. Ray could not be reached for comment.
Gillard, who Hamilton said has a prior arrest for first-degree robbery, is charged with first-degree burglary and could face further charges.

Shooting through a barred door can be considered criminally-irresponsible on the part of the householder.
It would seem to me that observing someone holding a gun, in the act of breaking a storm door, would provide any reasonable person enough justification to shoot the person holding the gun and breaking the window.
I missed the part where he fired through a barred door.
If it were in fact a barred door, sufficient to keep an intruder out, then perhaps I could see your point.
But I think I'd still shoot the son of a bitch and pull him inside.
No, it was just an alleged hand, holding an alleged gun, possibly attached to an alleged intruder.

In particular, did you read the part about the guy outside pointing a 9mm at the resident through the barred door?
By barred I asumme you mean locked. Do you have to wait until the armed intruder is actually in the house? In some countries and some states, yes. Is that common sense, no. I think intent was apparent. Good luck to the homeowner.

That's not exactuly true, Jihad. In Texas, if you are on my property without my permission after dark, you can get shot--that's the law.
I have heard that one also, some of those guys are pretty heavy ;)
