Judge's error to save Terri Schiavo?

Terri Schiavo is not hooked up to any machines, but she requires a small feeding tube for nourishment and hydration. In 2000, Greer ordered that the tube be removed, and last week, denying a motion for a further stay, gave the Schindlers until March 18 at 1 p.m. to appeal before the order is carried out.

At the 2000 trial, Greer, although initially finding Meyer's testimony 'believable,' concluded that the conversation could not have occurred in 1982, because he believed Quinlan died in 1976. At that time, Terri would have been only 11 or 12 years old and, therefore, would not have made her end-of-life wishes as an adult.

The new motion contends it was Greer who was mistaken and not Meyer, because Quinlan did not die until 1985, about 9 years after her court case ended and her respirator was removed.

None of the attorneys working on the Schiavo case in 2000 apparently noticed the mistake in dates, according to the Schindlers' attorney David Gibbs.

"No one told Judge Greer that Karen Ann Quinlan was alive in 1982, making it entirely appropriate for Diane and Terri to discuss her situation in the present tense," his firm said in a statement.

Gibbs said that if Greer's 2000 order authorizing husband Michael Schiavo to end his wife's life were a criminal death sentence, Terri Schiavo would be entitled to a new trial on the basis of a reversible error.

"Although Terri is not a criminal, she is still under a court-imposed death order, an order that is the equivalent of a death penalty," Gibbs said. "Therefore, we are asking Judge Greer to correct his mistake by either reversing his 2000 order or conducting a new trial."

As WorldNetDaily reported last week, Greer denied the Schindlers' motion for an indefinite stay to pursue medical tests that might prove their daughter could benefit from physical therapy.

Terri Schiavo collapsed under disputed circumstances Feb. 25, 1990, suffering severe brain damage when her heart stopped momentarily. Michael Schiavo contends his wife had an eating disorder, and the court agreed she is in a "persistent vegetative state," but her parents suspect he tried to strangle her, and insist that while mentally handicapped, she recognizes people and responds to stimuli.

The Schindlers want to get TV cameras in their daughter's room at the Woodside Hospice in Pinellas Park, Fla., where she lives, to document that she is not "comatose," as often has been reported. But Michael Schiavo keeps tight control of the vistors list and has barred filming and photographing.

The family's hopes also have been lifted by news that Florida's Department of Children and Families is launching an abuse probe. If neglect or abuse can be proved, the state can take over guardianship from Michael Schiavo.

The Schindlers have filed motions to remove their son-in-law as Terri's guardian, arguing he is her husband in name only and consistently has sought to withhold care and therapy. Michael Schiavo has been living for 10 years with fiance Jodi Centonze, with whom he has two children, and plans to marry her upon Terri's death.

Another option for the Schindlers is an appeal to the U.S. Supreme Court on religious liberty grounds, asserting Terri Schiavo's Catholic beliefs would be violated by invoking her "right to die."

Meanwhile, the National Right to Life Committee is calling on Congress to enact a bill to be introduced by Rep. Dave Weldon, R-Fla., that would give the Schindler family access to a federal court to argue for the life of their daughter.

"Congress can act to ensure a federal court hearing on whether or not Terri will die of starvation and dehydration," said Lori Kehoe, congressional liaison for NRLC's Robert Powell Center for Medical Ethics.

Kehoe said a proceeding known as the "writ of habeas corpus" been used to give a hearing to those whose liberty has been constrained by state courts in violation of the Constitution or federal laws.

Weldon plans to introduce the bill March 8.

"We call on all citizens to immediately contact their U.S. senators and representatives and urge them to support Representative Weldon's bill to amend the Habeas Corpus Act to allow its use when a state court orders denial of food or fluids in cases like Terri's," Kehoe said.

Is that what the Doc's said brought on a heart attack?

I don't know. She was bulimic, and bulimia is known to lead to heart attacks. That's all I know.

The old lady I wrote about just consumes--she's got the cash, but you could sure make an argument for complete uselessness, even destructiveness. There are all kinds of states of "I wouldn't want to live like that"....

But it's been years since those around her were afflicted with the "walking out into the snow" scenario...Not since she really got "past her time of usefulness" and is simply existing to be entertained and served. (g)

After reading this I find it outrageous that ANY judge would allow the "husband" to make any decisions regarding her care. These are NOT the injuries one would expect to see on a relatively young woman.

Bulemic's have bad hearts. Terri has a STRONG heart.

Think about it, she survived almost 8 days of starvation over a year ago.

Doctors dispute the bulmia story.

How do you explain the Bone Scan from 1991, that shows possible strangulation?? There's lots of suspious things in this case.

I know, it's really outrageous!! Femurs aren't easily broken. IF MS failed to notify authorities and the Dr. who did the scan also didn't notify authorities they should be charged.

DId you know that when the Gov. became involved in the case re the unconstitutionality of Terri's Law that Felos wanted that bone scan removed from the court record?

Hopefully since DCF has stepped in to check on Terri something positive will happen for her. Her "husband" hasn't made any attempts to improve her condition.

Terri Schiavo's Parents File Appeals

Attorneys for Terri Schindler Schiavo's parents on Monday filed a slew of new motions with the judge who ordered the disabled woman's food and water to be withdrawn -- and also with a Florida appeals court.

Attorney Barbara Weller said the parents, Bob and Mary Schindler, are seeking to prevent their daughter's court-ordered death by starvation and dehydration.

The motions were filed after Florida 6th Judicial Circuit Judge George W. Greer ordered Schiavo's execution by removal of food and water to commence March 18.

"We have motions everywhere," Weller told CitizenLink today. "We filed 15 motions with Judge Greer and two motions with the 2nd District Court of Appeals appealing Judge Greer's order. After all, the judge has issued the equivalent of a death sentence. And death sentences in Florida are supposed to be reviewed."

Weller said one of the Schindlers' motions asks the judge to approve a petition for divorce for the brain-disabled woman, citing open adultery on the part of Terri's husband and guardian, Michael Schiavo. The parents also want to compel Michael Schiavo to answer questions about his guardianship; and are seeking a motion to remove him as guardian, citing his failure to comply with Florida law.

The Schindlers are also seeking an updated neurological evaluation of their daughter's capabilities, based on new MRI testing protocols, as well as the authority to provide Terri with any updated rehabilitation she needs to stay alive.

Bruce Hausknecht, legal analyst for Focus on the Family, said it is extraordinary that Terri's parents have been forced to file so many appeals -- and to take the step of asking the Florida Court of Appeals to keep their daughter alive.

"Judge Greer should have granted the stay in the first place to allow time for these very serious matters to be heard," Hausknecht said. "To stop the clock on Terri's life on March 18 while motions are pending in her guardianship is to totally abdicate his duties as a judge and shows a total disregard for her right to life."

Interestingly, members of the news media have also filed motions with Greer to be allowed to visit Terri to see themselves what condition she is in.

I can't remember and find Terri best friend's/co-workers written testimony
about seeing her bruised at work.
The best friend who testify that Terri told her she had it with MS and wanted a divorce and was going to tell MS that night in 2/1990. Can you help me find that information.

told her(Terri) to stay at her home , because Terri was in fear .

It's quite possible she had an eating disorder, but I'm not convinced that it caused the 'heart attack,' if there ever was one. It seems just as possible to me that her condition is caused by some yet to be confirmed extreme abuse, possibly reaching the level of attempted murder.
Pure speculation on my part.

That is criminal in itself. After pocketing her million Dollar injury award, and not spending it on her rehab, this leads one to logically suspect that the guy is clearly up to some chicanery. It leads one to believe that he is a greedy "thief," or he is incompetent. Either situation should have resulted in his removal as spokesman for her. Since this has not happened, one could conclude that the judge is either incompetent or has conflicting motives. Either situation should have led to his removal from the case.

Something is clearly stinking here. This judge should be investigated. If he is found to have relied upon flawed logic, then one must ask if this is a case of a premeditated attempt at murder. If he successfully kills Terry, this case should not end. There is a possibility that this judge could himself eventually reside on "Death Row."
