Terri's Freepers,

Judge George Greer denied Terri's parents' Motion for a Stay to protect their daughter's life while there are still pending issues in this LIFE AND DEATH MATTER. In addition the Department of Children and Family Services made a surprise visit to the court hearing the other day and asked Judge Greer if they could approach the bench. Judge Greer denied DCF the opportunity to speak. DCF asked for 60 days to conduct a complete investigation of allegations that have surfaced in the form of a Complaint to their agency.

What was set in motion instead? On Friday, February 25th, Judge Greer REFUSED TO issue another Stay because he was "not comfortable" issuing a say to protect a Ward of the State but instead "set a date certain" (on his calendar at least, not on mine) to BEGIN THE BARBARIC, ANTI-AMERICAN, STARVATION-DEHYDRATION SLOW MURDER OF TERRI.

Attorney Gibbs for Terri's parents held a press conference after J. Greer's order that was so tastefully written to indicate that "he was giving the Schindlers until March 18th so they could "prepare for Last Rites." Attorneys Gibbs called this ruling and prior rulings "Hitler-resque". Indeed.

If Judge Greer wasn't LEGALIZING EUTHANASIA in his courtroom, why any need for Last Rites? Greer's urgency to fulfill this killing places urgency on every one of us to lobby Governor Bush, Florida's House and Florida's Senate.

A Judge in America is ordering the manner of someone's death, a disabled woman who is healthy but needs rehabilitation.

Time is short so we don't really have time to get into Greer's mind to see why he is Florida's Til of the Hun.

What can we do?

Finally, the Pope has no Living Will. He will be SAFE as long as he stays away from George Greer's courtroom. The Pope is in our thoughts and prayers and he knows of Terri. He wants Terri to be freed from oppression and from a painless death by starvation-dehyration.

I believe we all have a duty to speak out against evil when we see it, including our top leaders.

Why are so many keeping quiet about this travesty?

There's nothing shameful for being out front to save Terri's life. It surprises me at the attitude that it will hurt their polical future if they come out for Terri.

Why are so many keeping quiet about this travesty?

I don't understand it. Why are judges now ruling the country like this? Why are politicians allowing this takeover by the judiciary?

I also called up Sen. Martinez to thank him. Then I called my two Senators, Elizabeth Dole and Richard Burr. I called them before this bill was introduced. Their phone screeners are nice, but I'm just not getting the feeling that there is a high priority on this case. They can't even tell me what my senator's position on the bill is. I have called them and emailed both senators previously asking for their help. My senators have not seen fit to issue a statement on the bill or Terri's case.

I don't think they are getting enough phone calls.

WASHINGTON, March 9 (UPI) -- Two Florida lawmakers have filed a bill that would give a brain-damaged Tampa woman kept alive by a feeding tube access to a special federal court hearing.

Sen. Mel Martinez and Rep. Dave Weldon, both Republicans, said incapacitated patients like Terri Schiavo should have the same type of federal hearing as death row prisoners, the Orlando Sentinel reported Wednesday.

"This legislation is about due process and equal protection for disabled individuals like Terri Schiavo. It ensures Terri has the same federal legal protections as convicted murderers," Martinez said.

George Felos, attorney for Schiavo's husband, Michael, said it was a "horrible" idea.

"To allow never-ending federal review of state court decisions would make it virtually impossible to carry out patients' wishes if anyone in the family disagreed," Felos said.

Terri Schiavo is at the center of a legal battle between her husband, who wants to remove her feeding tube because that would be her desire, and her parents, who want to keep her alive.

Martinez seeks federal intervention for Schiavo
The freshman senator and a representative file a bill as the court battle continues over her fate.

WASHINGTON - Wading into a political thicket that has confounded Florida's Legislature and its governor, U.S. Sen. Mel Martinez on Tuesday joined a fellow Florida congressman in filing a bill to let the federal courts review the Terri Schiavo case.

Martinez, R-Orlando, and U.S. Rep. Dave Weldon, R-Palm Bay, are asking the Republican leadership in their respective chambers to act quickly on the bill, before Schiavo's feeding tube is removed next Friday. But it was unclear whether that would be possible; aides said Democrats would likely insist on full hearings, which could delay the bill for weeks.

Schiavo suffered severe brain damage after collapsing 15 years ago. Her husband, Michael Schiavo, contends she would not want to be kept alive artificially, but she left no living will. Her parents, Bob and Mary Schindler, contend she might get better.

While lawmakers filed bills, an attorney for the Schindlers was back in a Clearwater court Tuesday urging Pinellas-Pasco Circuit Judge George Greer to consider testimony from 33 doctors who think Schiavo can recover from her injuries. Most of the doctors contacted the Schindlers after hearing about the case through widespread media attention.

David Gibbs III, the Schindlers' attorney, said some of that testimony will indicate that Schiavo can learn to swallow. Some of the doctors also may testify that Schiavo is in a minimally conscious state and could recover.

Greer will consider the motion. The judge, however, denied a request from Schiavo's parents to have her fed by mouth after the feeding tube is removed.

Court hearings resume today when the state Department of Children and Families seeks to intervene to investigate allegations of abuse against Michael Schiavo. DCF asked Greer on Tuesday to bar the public from the hearing scheduled for this afternoon.

DCF attorney Keith Ganobsik would not tell reporters why the agency wants to close the hearing. Greer may consider DCF's request this morning.

George Felos, attorney for Michael Schiavo, said he thinks DCF's involvement has been prompted by the same political meddling that has fueled other efforts by lawmakers to keep Schiavo alive. He said any hearings with DCF in front of Greer need to be open to the public.

"This thing simply reeks of political intervention," Felos said, later adding: "The public needs to see these proceedings, especially in this case, to see the political arm-twisting that's going on."

The director of DCF has denied that political pressure led to the agency's motion to intervene.

The Schiavo case prompted Florida's other U.S. senator, Democrat Bill Nelson, to file his own bill to make simply worded living wills available at state driver's license offices. Nelson said he has asked for a legal review before deciding whether to support Martinez's bill.

"This is not about Terri Schiavo's right to die or right to be kept alive," said Martinez, a lawyer. "It is about ensuring that her rights have been protected throughout this process."

This is Martinez's first bill since taking office, and it mirrors Weldon's. They said it was written narrowly in hopes of avoiding a broader fight over such issues as abortion and physician-assisted suicide, and would apply only to people who meet four requirements: They must be legally incapacitated; there must be a state court ruling to withhold sustenance; there must be no written directive; and there must be a legal dispute, as in Schiavo's case.

A "party of standing" could ask a federal court to review the case, to ensure that the patient's rights of due process weren't violated. Martinez and Weldon said the same right is allowed in death penalty cases. "Her parents do not want to see her dying of starvation and thirst," Weldon, a physician, said on the House floor as he introduced the bill.

Nearly two years ago, the Florida Legislature passed Terri's Law, which gave Gov. Jeb Bush the power to reverse a court order to remove her feeding tube. The state Supreme Court struck down the law.

I did.

Our leaders have to speak up for what is right. I don't want to see Terri have to go through another 6 days of starvation! She has had her tube pulled twice already. We have to do all we can to prevent the State of Florida from starving her again and that includes our leaders speaking out for what is right.

Support for Terri should be out in the open. She's not a dirty little secret, but a beautiful human being that is scheduled to be tortured to death.

Washington, DC (LifeNews.com) -- Lawmakers in Congress made it official on Tuesday when they introduced legislation that would allow Terri Schiavo's family to take their case to prevent her starvation death through the federal court system.

Rep. Dave Weldon and Senator Mel Martinez, both Florida Republicans, introduced companion measures in the House and Senate. They said disabled patients like Terri Schiavo should be able to have the same rights as prisoners on death row.

"This legislation is about due process equal protection for disabled individuals like Terri Schiavo," Martinez said. "It ensures Terri has the same federal legal protections as convicted murderers."

The bill would allow Terri's parents to use a "writ of habeas corpus" to take the case out of the Florida state courts and to federal courts. The habeas corpus review would apply to any other patients like Terri who are subject to involuntary starvation and that's what's earning it praise from disability activists.

However, George Felos, the euthanasia advocate who is Michael Schiavo's lead attorney, told the Sun-Sentinel newspaper that the legislation was a "horrible" idea.

"To allow never-ending federal review of state court decisions would make it virtually impossible to carry out patients' wishes if anyone in the family disagreed," he claimed.

Felos said the bill was unconstitutional and could cause years of delays in Terri's parents' case if it becomes law. Supporters of the bill counter that what has been unconstitutional is the violation of Terri's 14th Amendment due process rights.

"A court order to withdraw food and water is pretty extreme. For the federal legal system to sit by idly and let the state do that would be a dereliction of duty," Weldon said in explaining the rationale behind his bill.

Weldon and Martinez are hopeful they can run their bills quickly through the legislative process. Already, 62 of the 435 members of the House of Representatives have signed on a co-sponsors of Weldon's measure.

Passing the bill in the Senate may prove more difficult -- especially if any senator launches a filibuster. At that point, 60 votes would be needed to end debate and vote on the bill.

I take issue with that remark, FR, for it denegrates the many things people are doing behind the scenes for this mother's child. What we see and hear as silence may be the better part of discretion in knowing when to speak. My thoughts, and I'll say nothing more on this disagreement on this thread.

I agree, Pegita. There's no sense in broadcasting what is being done or what will be done. It just gives the Enemy a chance to spin it for the media. For example, some people think that Gov. Bush is not doing enough, but I expect somewhere along the way he played poker with his brother and knows enough not to show his hand until he has whatever trump cards he needs lined up.

TALLAHASSEE - The governor gave his State of the State address to the Florida Legislature on Tuesday, outlining his goals for the coming legislative session. He did not mention any proposals aimed at keeping Terri Schiavo alive, but that doesn't mean he's not thinking about it.

Pushing through a gaggle of reporters, Jeb Bush did say he'd like to move quickly on a bill to keep Terri Schiavo alive.

"Well, by definition, it's going to have be done -- I don't know what 'it' is, to be fair about it -- but it would have to be pretty soon," he told Action News reporter Don Germaise.

But it's not clear if lawmakers will beat the March 18 deadline, which is when a judge says Terri's feeding tube can be removed.

"There are very, very bright lawyers in the Florida House and Senate looking at this issue, and it's not easy. I don't want to get expectations up; there may not be a legislative remedy for this issue, but we're going to give it a try in the Florida House," House Speaker Allan Bense said.

Clearly, lobbying has begun 10 days before this latest deadline -- including, apparently, Terri Schiavo's husband," who is fighting Terri's parents to have her life support disconnected.

"I got a phone call today from Mr. Schiavo," Senate President Tom Lee said. "We're going to try to be fair to him and fair to Terri and all the people who have feelings about end-of-life issues,"

Several lawmakers told Action News they suspected the new law may be just as unconstitutional as the original Terri's law, but some planed to press ahead with it anyway.

A similar effort may be gaining steam in the U.S. Congress. Two congressional lawmakers introduced legislation Tuesday that could be pivotal in the case.



David Gibbs III, the attorney for Terri's parents, argues that Michal Schiavo is obliged to consider new treatment.
New Florida senator Mel Martinez and Congressman David Weldon from Florida's Space Coast say the Incapacitated Person's Legal Protection Act will give Terri, and those like her, the constitutional protection of due process.

Meanwhile, a Pinellas County judge Tuesday denied a request by Terri Schiavo's parents to try to feed their daughter once her feeding tube is removed. But the Schindlers were back in court with new motions.

The family's attorney argued medical advancements made over the past two and a half years may be able to rehabilitate Terri. But Michael Schiavo's attorney says the treatments the family proposed won't help someone in Terri's condition.

"The court doesn't act on a public opinion poll of doctors," George Felos stated.

Judge Greer will decide by Wednesday afternoon whether more should be heard on the motions introduced Tuesday.
