Action Alert:  Oppose H.R. 418 (national ID)

February 8, 2005


Are the terrorists winning?  When al-Qaeda attacked the United States on September 11, 2001, they made it clear they hate America and want to terrorize us into changing America.

If they could, the terrorists would destroy the unique American way of life.  But they can't.  Only we can do that.

Tragically, too much of the legislation enacted by Congress in a knee-jerk reaction to 9/11 does al-Qaeda's job for them.  The Patriot Act took the first, disastrous step toward fundamentally changing our way of life.  Then came the homeland security bill, followed by the 9/11 intelligence reorganization bill.  And now the Real ID Act of 2005 (H.R. 418) will be voted on Thursday, February 10th.

What's wrong with H.R. 418 -- a bill we are told will stem the flow of illegal aliens through our porous borders?  For starters, it does NOTHING to stem the flow of illegal aliens.  Instead, H.R. 418 will:

1.  Establish a national ID card.
2.  Establish a federally-coordinated database of personal information on American citizens with Canada and Mexico.
3.  Use the new national ID to track American citizens when traveling outside the U.S. -- and within the U.S.
4.  Re-define "terrorism" in broad new terms that could include members of firearms rights and pro-life groups or other such groups as determined by whoever is in power at the time.
5.  Authorize the secretary of the Department of Homeland Security to unilaterally expand the information included in driver's licenses, including such biometric information as retina scans and DNA information -- and even radio frequency identification (RFID) tracking technology.  Carry a driver’s license with RFID and governmental officials will know your whereabouts 24/7.

Incredibly, H.R. 418 does nothing to solve the growing threat to national security posed by people who are already in the U.S. illegally.  Instead, H.R. 418 states what we already know: that certain people here illegally are "deportable."  But it does nothing to mandate deportation.  H.R. 418 fails miserably on this most critical issue.

The Real ID Act or Real National ID Act will impose a Soviet-style internal passport on law-abiding American citizens.  Proponents of H.R. 418 say we must "make sacrifices" like this to control our borders and fight illegal immigration.  But H.R. 418 is a Trojan horse -- it pretends to offer desperately needed border control in order to stampede Americans into sacrificing what is uniquely American:  more of our constitutionally protected liberty.  H.R. 418 does what al-Qaeda could never do without our help.

H.R. 418 does what legislation restricting firearm ownership does.  It punishes law-abiding citizens.  Criminals will ignore it.  H.R. 418 offers us a false sense of greater security at the cost of taking a gigantic step toward making America a police state.  The terrorists will have won.

I agree with you. We all have a SS card, we have a passport that allows the government to track our movement outside the country and we have to get a driver's license every time we move to a different state. It is necessary to have the driver's license or state issued ID card or the passport to get on an airplane.

Who are the citizens that don't have these documents now? I would prefer to have a single document that served as a passort, a SS card and a federal driver's license.

I doubt if I can hide now so a national ID card won't make a lot of difference.

RFID has a range of no more than 3 or 4 feet. It's not a "tracking mechanism" and anyone who tells you it is is a few bubbles off of plum.

I dont know. I have the average citizens knowledge. Does it forbid only when Congress does not give its consent?

Maybe. In todays times, the phrase "give up essential liberty" could mean anything at all - depending on personal politics. For a lot of liberals, it could mean having to wait in line more than one minute to vote, or paranoia that the government is actually interested in listening to you speak to aunt emma on the phone...

The link to the thread you provided, Parents Protest School Mandate That Students Wear Radio ID Tags , should help you understand.  You can't track the RFID tags from a distance, only when they pass within a few feet of a reader.  All it will tell you is that the RFID tag passed a given spot.  It's like putting a video camera on a doorway.

It's not a tracking mechanism for a person.  It's more a turnstile gate for a doorway, or some similar access point.  Same thing happens when you pass your authorized badge over the reader on a secure building.

I did, however, really spook some of my coworkers.  We had cell phone antenna boosters installed by Cingular in our data center (reception was awful).  The antennas were little domes, about 4 inches across and 6 inches high, attached to the ceiling in the hallway in pairs about a foot apart.  We have access badges for the building and I told a few folks that the antennas were to allow management to track us.  Several of them believed me.

I don't have much patience for folks who don't understand technology and freak out about the wrong things.  It is fun, however, to play with a Luddites head some.

You call federal identification standards "government activity that isn't constitutionally authorized" and "illegitimate."

But the constitution does authorize this legislation:

The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing [sic] Senators...

(There are additional specific powers pertaining to protecting voter rights as related to race, sex, age, employment, tax delinquency, etc.)

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence [sic] and general Welfare of the United States...

To establish an uniform Rule of Naturalization...

Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof.

But "records" are necessary to carry out the laws which are authorized by the constitution. And these records entail gathering and keeping data.

As I have pointed out before in this forum, the "right to privacy" is not explicitly stated in the constitution. It is correctly inferred in some instances, but it is not universal and does not provide protection to specific behavior. These legal ideas are part of the problem with modern constitutional thinking in our courts. There is the idea of extrapolating ideas and inventing rights that do not exist.

We already have a de facto National ID. Its called a drivers' license. All this bill will do is create a federal database for tracking drivers' licenses and make sure future Mohammed Attas can't get one to drive around to commit mayhem.

We have 50 separate state ID cards. There's no need for people to carry a federal card. But there's a pressing need for a federal database to weed out fraud, abuse and gaming the drivers' license system for nefarious or criminal purposes. This bill does that and requires states to establish safeguards for drivers' licenses, among them, keeping them out of the hands of illegal aliens. In this day and age, its important to do everything we can to protect our borders.
