While I agree with you if these were American citizens, part of me screams these are not Americans, they are here as enemy combatants sans country, and the dems want us to use the courts against them. Basically they want our hands tied when they should be questioned if they could be if not they should be taken out(yes killed). This is war, and they are here to disrupt and kill Americans.
What happened to spies or saboteurs in every other war? And since they are here without the backing of a country just a religion, even those rules do not apply. We are dealing with a totally new type of combatant, perhaps they should have signed on to the Geneva Convention before starting this war, though no islamic country ever keeps that promise, but at least we would have.
While it is a very dangerous precedent, it is one bound by certain rules, come here to destroy us because of your religion not your country, Geneva does not apply. They knew that coming here, they just thought we were wimps, they know it now if they come.

I was alluding to the fact that combatants without uniforms or command structure are not covered by Geneva Conventions. What goes on after that is a different argument that you can have with someone else.
My point is that we have yet to publicly and clearly and repetitively differentiated between Geneva-covered combatants and terrorists up front.
