Lawyer drops motion after brother testifies
Ishmael Salahud-Din, the man accused of shooting three police officers at an apartment complex in November 2003, might have had a chance to get out of jail Friday. Until his brother took the stand to testify on his behalf.
Salahud-Din has been in jail for more than a year with a bond set at $1 million. He faces multiple felony charges that include five counts of attempted capital murder.
Last month, his court-appointed attorney, Mark Woerner, filed a motion to reduce that bond to give Salahud-Din a better chance at getting out of jail while he awaits trial. District Judge Nanette Hasette held a hearing Friday to determine if such a reduction was reasonable.
That hearing didn't take very long.
One of the first things Woerner had to prove was that Salahud-Din's family had no chance of making the bond, so he called Salahud-Din's brother, Khalid, to testify.
Woerner's first question to Khalid was whether the family could afford the $1 million bond.
"I thought it was $3 million," Khalid replied.
No, it is in fact $1 million, Woerner said, and again asked if Khalid really thought his family could afford that kind of money.
"If I make the right phone calls," Khalid said. "If we make it, we make it. If we don't, we don't."
Prosecutor Adolfo Aguilo, who had planned to argue against the bond reduction, told Hasette the defense had failed to meet its most basic burden.
Woerner seemed surprised to hear Khalid suggest the family might be able to afford the $1 million bond.
"This is news to me," he said, before dropping the request.
As he was leaving the courthouse on an elevator, Khalid turned to Woerner and said Aguilo didn't look very intelligent.
"Don't underestimate him," Woerner said. "They give me the difficult ones."
