ACLJ Opposes Legal Challenge to Inaugural Prayer

(Washington, DC) – The American Center for Law and Justice, specializing in constitutional law, is opposing a legal challenge brought by California atheist Michael Newdow challenging the constitutionality of prayer at the Presidential inauguration. The ACLJ has filed an amicus brief in support of the Department of Justice’s position defending the constitutionality of inaugural prayer.

“This challenge is legally flawed and represents nothing more than an attempt to remove a time-honored tradition going back to the nation’s first President,” said Jay Sekulow, Chief Counsel of the ACLJ, which has challenged Newdow’s lawsuits in the past. “The expression of prayer at the Presidential inauguration is not only constitutional, but an important part of the history and heritage of this nation. We’re confident that this legal challenge will meet the same fate of a similar challenge brought by Newdow four years ago concerning inaugural prayer – a legal challenge that was rejected by the courts.”....

If we have a real President he will take the oath on the Bible and no judge's decision, will matter. It is time for the President and the Congress to put the courts in their place.

Unfortunately I don't think they have refused to do this out of ignorance, I fear they really approve of these rogue judges decisions, and are letting them take the heat, since the judges don't face re-election.

Acknowledgement of the Creator is the basis of all American law.

The first self-evident truth is that all men are created equal. This acknowledges a Creator even before the acknowledgement of equality.

Furthermore, just in case someone should try to insinuate uncertainty about this, the clause that follows makes it clear that men were created by a Creator.

The foundation of U.S. law is the self-evident truth that all people are endowed by their Creator with certain inalienable rights.

They were not given these rights by government. They were not given them by some covenant. They were not given them by other people. These rights did not come through evolution from lower life forms.

They came from the Creator of human beings.

The acknowledgement of the Creator is the foundation of American law.

The American people need to keep this in their awareness, and anyone who seeks to expunge the recognition of God from American law should be stopped.

It is probably no accident that freedom of speech is the first freedom mentioned in the First Amendment: "Congress shall make no law . . . abridging the freedom of speech, or of the press, or of the people peaceably to assemble, and to petition the Government for a redress of grievances." The Constitution's framers believed that freedom of inquiry and liberty of expression were the hallmarks of a democratic society.

The ACLU of course has edited out freedom of religion, which comes ahead of speech. (Thanks to James Taranto)

I appreciate your good intentions. But frankly, I think the strongest response to the wacko suit is simply to ignore it. If the Chief Justice of the Supreme Court goes ahead and swears the President in on a Bible, and someone simply calls upon a respected Minister to offer a benediction, just what Court in these United States would take jurisdiction to even try to punish someone for contempt? I do not think the suit is going any place but the "Saturday Night Live" circuit.

The publicity the ACLU gets has made every one gun shy. And that increases their ability to intimidate local officials across the length and breadth of the land. But this is one instance where the logistics are completely against them. They should be told to "bring it on," indeed.
