SAN FRANCISCO (AP) - An atheist who sued because he did not want his young daughter exposed to the words "under God" in the Pledge of Allegiance has filed a suit to bar the saying of a prayer at President Bush's inauguration.Michael Newdow notes that two ministers delivered Christian invocations at Bush's first inaugural ceremony in 2001, and that plans call for a minister to do the same before Bush takes the oath of office Jan. 20.
In a lawsuit in U.S. District Court for the District of Columbia, Newdow says the use of a prayer is unconstitutional. The case is tentatively scheduled Jan. 14.
Last year, the San Francisco-based 9th U.S. Circuit Court of Appeals tossed the same lawsuit, saying Newdow did not suffer "a sufficiently concrete and specific injury." But the decision did not bar him from filing the challenge in a different circuit.
Newdow is best known for trying to remove "under God" from the Pledge of Allegiance.
He won that case more than two years ago before a federal appeals court, which said it was an unconstitutional blending of church and state for public school students to pledge to God.
In June, however, the Supreme Court said Newdow could not lawfully sue because he did not have custody of his elementary school-aged daughter, on whose behalf he sued, and because the girl's mother objected to the suit.
Newdow refiled the pledge suit in Sacramento federal court this week, naming eight other plaintiffs who are custodial parents or the children themselves.
Here in California, people like Newdow used to be locked up in a padded cell at one of our mental hospitals. Under pressure from the Dims, Reagan closed most of the hospitals. The state has been overrun by loonies ever since.
This guy is the biggest jerk in the country.

I bet President Bush's attorney is shaking in his boots over this lawsuit....NOT! He will find that he has come up against the wrong cause this time.

It's long past time for a showdown with the court system in this country.
The left-wing judges are trying to remake the face of America, in their marxist, atheistic image.
Judges should all be elected so they are answerable to THE PEOPLE!
That includes the Supreme Court!
If we have to change the Constitution to do it, so be it.
But the bottom line is tolerance. We tolerant his atheism and deserve equal tolerance. NO ONE is forcing him to believe in God.
Same guy who is behind on his child support payments? Seems like Hannity asked him something about that and he sidestepped it and Hannity did not pursue it. I wish Pres Bush would have a half dozen ministers praying at the inauguration.
Those who wish to deny that there is a God wish to become God. What we have is very little people who want tell us they are the allknowing. Society needs to be watchful of those say lesson to me and I will tell you the truth, this should come from within.
Again, Mr. Newdow....the only part of the program that is governmental is the administered oath of office.
Unless Pres. Bush stops in the middle of that oath and starts praying, Newdow doesn't have a case.
All the trappings before and the trappings after that oath are ceremonial. There is no required attendance for anyone. Cameras are not required to be there. Mr Newdow is not required to watch.
I believe that FDR's final inauguration was a private gathering due to his illness or circumstance.
Neudow also said after the first time he lost, that the reason he lost was because there aren't enough Homosexual judges. Now we know why they never married.
Newdow has already fled the family of God.

If the courts start sending clowns like Newdow a bill for these frivolous lawsuits then they will quit cluttering up the judicial system with this tripe...
I pray that a D.C. Circuit Court will "bar" any prayers from the Inuagural, and that bush goes ahead with them anyway. The best way for we the people to twart the will of the courts is to ignore their unlawful rulings entirely.
