Robber Gets A Surprise From Potential Victim

(Hampton, VA, December 14th, 2004, 6:54 a.m.) On the Peninsula, it's the bad guy lying in a hospital bed, while his intended victim is unscathed. Your NewsChannel 3's Kathleen Carey has the story of the victim that fought back.

Hampton Police say it's a case of an armed robber going after the wrong guy. Instead of a Hampton man becoming the victim of an armed robbery, Hampton Police say he turned the tables on his attacker. In the parking lot behind the "Treasure Chest" nightclub on East Pembroke Avenue, police drew circles around empty shell casings, drawing the conclusion that 22-year old Tony Kensler, Jr. Newport News pulled-out a gun to rob a man, just to be surprised that his intended victim fought back.

That man had a permit for a concealed weapon, and he's the one who got off the shots, hitting Kensler in the arm, leg and chest. Police say it was self defense, and those who we spoke with agree. Sarah Daniel lives nearby, "I think he had every right to do what he did. If someone came up to me, I'd use any means of self defense that I had." Charli is an employee of the club, but wasn't working the night of the shooting. Still, she has an opinion, "I think the bad guys need to have something happen to them for a change, instead of always have some innocent person die."

Kensler, listed in fair condition at Riverside Regional Medical Center, is charged with possession of a firearm by a convicted felon and possession of crack cocaine. Police are looking for another person who may have been helping Kensler. There was a car parked near the scene of the incident that could be involved in the stick-up attempt. Police say inside the car was a second suspect who they are still looking for. That's why they haven't released the name of the victim. They don't want to jeopardize the ongoing investigation.

The gentleman's club has surveillance video of the incident and the owner says she is cooperating with Hampton Police. Police are reviewing the tapes, hoping to identify the getaway car. Kathleen Carey spoke to Kensler's mother. She didn't go on camera, but says she goes on the record of believing that her son is innocent. She says her son shot as he was being robbed. PLEASE, NO!!! Do not promote this as a method of defense using a small caliber weapon... If you are dealing with a revolver, then yes, the expanding gases would enter the wound channel and cause more damage. You have also just put yourself within grasp of the bad guy - something best avoided all together. If you are using a pistol, jamming the muzzle of the pistol will (unless you are just barely touching him with it) move the slide of the weapon far enough back out of battery to cause it not to fire. (On many pistols, all it takes is a small fraction of an inch.) If that happens, you will likely find yourself in a struggle for the weapon - not good. If I can get my hand arond the slide of your weapon, I can get the slide out of battery and use my free hand to: (your choice) punch, stab, or bludgeon you.

Never get in to a physical scuffle with a perpetrator if you can distance yourself from him and eliminate the threat. In other words, back up using a "step and drag" retreat (preferably to the bad guy's "weak" side) while facing the perpetrator and firing at him. Distance is your friend if you are an accomplished marksman in an armed confrontation. Do not try to make up for poor marksmanship by moving closer to the bad guy. Make up for poor marksmanship by getting out to the range and practicing under "stress environment" conditions as much as possible.

PS: Carry a big enough caliber so that you do not have to think about using any other part of the pistol/revolver (or the by-product [expanding gases] of firing it) as a weapon. A 9mm is at the bottom end of that scale.

A much better method of stopping an attack is: chest, head, chest, head, chest, head, head, head. Reload, find moist towelette.

One good torso or "A" ZONE hit and the guy's not down for the count? He's in fair condition? Musta been a smallish caliber. Two in the chest and one in the head...makes 'em dead.... is my motto.

Bingo! Exactly correct. In fact, the resulting wound looks very much like a contact shotgun wound. The flesh is seared and ripped open. But you'll likely get only one shot as the flesh will also get all embedded into the action of the weapon and may likely foul it up. Very messy.

This reminds me of the story a few months back in St. Louis about the elderly couple who were being robbed . . .

The robber had the wife at knife or gunpoint (can't remember which) and the husband came in. The robber told the man to give him all his money. The older man told the robber that he needed to go upstairs and get it.

The robber let him go upstairs and the elderly man came down with a gun and shot the robber. No charges were filed against the homeowner.

To put icing on the cake . . .

The elderly man was a retired Marine.

As a certified firearms instructor here in Florida, let me give you the scoop on this state. Florida rules say we're a SHALL ISSUE state and if it's all IAW the law, the permit must be issued within 90 days. My experience has been that especially in the area of fingerprints, the state will wait exactly 89 days before they kick them back and you have to start over. At least that's the way the system started out when we first got the CCW permit back in 1987. They've improved a bit over the years. But just a little bit.

Sorry to hear that.

What about assault with a deadly weapon and armed robbery? Those would seem more serious charges. The actual charges are malum prohibitum(against the law but not necessarily wrong in themselves) , while the latter two are malum en se (wrong in itself).

Not a very good shot, but it's the thought that counts sometimes.

One in the chest will stop most perps, as it did this one. Three hits is better than most police manage.

You'd be surprised. Some folks get hit with a .22 in the buttocks and they go down and out. Others, especially those on drugs or booze, even a .45 to the center of mass doesn't take them out...right away that is. The rule of course is to keep shooting until the threat is removed.

Ummmm. How many folks robbed the 'Treasure Chest' that day? Do the police think that the missing perp can't put 2(dec) and 2(dec) together to come up with 100(bin)? Ok.... (backing away slowly...

Obviously the accomplish knows he was there, and that his buddy didn't make it back to the car. What he probably doesn't know is who the "sheep" that turned out to be a sheep dog is. I'm sure the defender would just as soon the accomplish stayed ignorant.

RULES for a GUNFIGHT


1. Bring a gun. Preferably, bring at least two guns. Bring all of
your friends who have guns.

2. Anything worth shooting is worth shooting twice. Ammo is
cheap. Life is expensive.

3. Only hits count. The only thing worse than a miss is a slow
miss.

4. If your shooting stance is good, you're probably not moving fast
enough or using cover correctly.


5. Move away from your attacker. Distance is your friend. (Lateral
and diagonal movement are preferred.)

6. If you can choose what to bring to a gunfight, bring a long gun
and a friend with a long gun.

7. In ten years nobody will remember the details of caliber,
stance, or tactics. They will only remember who lived.

8. If you are not shooting, you should be communicating,
reloading, and running.

9. Accuracy is relative: most combat shooting standards will be
more dependent on "pucker factor" than the inherent accuracy of
the gun. Use a gun that works EVERY TIME. "All skill is in vain
when an Angel pisses in the flintlock of your musket."

10. Someday someone may kill you with your own gun, but they
should have to beat you to death with it because it is empty.

11. Always cheat, always win. The only unfair fight is the one you lose.

12. Have a plan.

13. Have a back-up plan, because the first one won't work.

14. Use cover or concealment as much as possible.

15. Flank your adversary when possible. Protect yours.

16. Don't drop your guard.

17. Always tactical load and threat scan 360 degrees.

18. Watch their hands. Hands kill. (In God we trust. Everyone
else, keep your hands where I can see them.)

19. Decide to be aggressive ENOUGH, quickly ENOUGH.

20. The faster you finish the fight, the less shot you will get.

21. Be polite. Be professional. But, have a plan to kill everyone
you meet.

22. Be courteous to everyone. Friendly to no one.

23. Your number one Option for Personal Security is a lifelong
commitment to avoidance, deterrence, and de-escalation.

24. Do not attend a gun fight with a handgun, the caliber of which does not start with a "4".
