Robber Gets A Surprise From Potential Victim

(Hampton, VA, December 14th, 2004, 6:54 a.m.) On the Peninsula, it's the bad guy lying in a hospital bed, while his intended victim is unscathed. Your NewsChannel 3's Kathleen Carey has the story of the victim that fought back.

Hampton Police say it's a case of an armed robber going after the wrong guy. Instead of a Hampton man becoming the victim of an armed robbery, Hampton Police say he turned the tables on his attacker. In the parking lot behind the "Treasure Chest" nightclub on East Pembroke Avenue, police drew circles around empty shell casings, drawing the conclusion that 22-year old Tony Kensler, Jr. Newport News pulled-out a gun to rob a man, just to be surprised that his intended victim fought back.

That man had a permit for a concealed weapon, and he's the one who got off the shots, hitting Kensler in the arm, leg and chest. Police say it was self defense, and those who we spoke with agree. Sarah Daniel lives nearby, "I think he had every right to do what he did. If someone came up to me, I'd use any means of self defense that I had." Charli is an employee of the club, but wasn't working the night of the shooting. Still, she has an opinion, "I think the bad guys need to have something happen to them for a change, instead of always have some innocent person die."

Kensler, listed in fair condition at Riverside Regional Medical Center, is charged with possession of a firearm by a convicted felon and possession of crack cocaine. Police are looking for another person who may have been helping Kensler. There was a car parked near the scene of the incident that could be involved in the stick-up attempt. Police say inside the car was a second suspect who they are still looking for. That's why they haven't released the name of the victim. They don't want to jeopardize the ongoing investigation.

The gentleman's club has surveillance video of the incident and the owner says she is cooperating with Hampton Police. Police are reviewing the tapes, hoping to identify the getaway car. Kathleen Carey spoke to Kensler's mother. She didn't go on camera, but says she goes on the record of believing that her son is innocent. She says her son shot as he was being robbed. Police must be hoping the second suspect will try again with the same "victim," who will have by this time brushed up on his marksmanship skills, and who will save them the trouble of an investigation!

The son is a victim???? I guess the shooter planted the crack on him then shot him or vise versa. Lets see, how bout this headline.... " Honor student in possession of crack Cocaine gets shot in wood-be robbery attempt..."

Now Mom is happy... (sarcasm)

If only he shot him in the head and killed him we would not have to pay to feed and comfort his criminal ass...

That was my take as well, a smaller caliber. But then, a .32 in the eye would still likely penetrate the thin bone behind the eye and prove fatal.

I have a .32 ACP, North American Arms. Good little "backup" weapon. From only a few feet away, I could inflict such a wound with it. From a much greater distance I would choose to aim at center body mass.

But then again, my "primary" is a Ruger .45 ACP. With that thing, pretty much anywhere central and above the nipples means lights out.

Yeah, and she also forgot to mention he was framed on that felony conviction and is sure that those little rocks in his pocket were candy.

Great article - thank you for thinking of me.

Still waiting (impatiently) for my FL CCW. We moved down three months ago and there was a *problem* with my prints - my ridges are not pronounced, so I have to go through the system the *long* way. Had that problem when I applied in GA, too.

If you're really forced to defend yourself with a small caliber handgun, I'd suggest trying for a "punch shot".

IOW, actually punch the perp with the muzzle and pull the trigger. The expanding gases going into the bullet hole will actually cause more injury than the bullet in these small caliber weapons.

I don't know, he hit him high (chest), low (leg) and wide (arm). Seems like he covered all the bases.

Actually the intended victim did quite well considering the circumstances. The BG had the drop on him, yet he drew and got 3 hits on his attacker, including one to the chest, without being hit himself. Seeing how he was shooting under a high degree of stress and adrenaline overload he was either good or very fortunate. Many trained cops don't do that well under more favorable conditions.

The only problem I have with this is the criminal is still alive. That is why I want to carry a 50 mag handgun and that would not happen.

Depends upon the order of the hits. Leg shot first to hobble the perp. He didn't drop his weapon so shoulder shot makes him drop it. 3rd shot to the chest just cuz the perp was a t*rd. ( I couldn't think of any other reason) Can you believe his mother? Talk about denial! Someone was robbing HIM (of his crack)! Guess that's her job in life.
