Woman denied custody in interstate lesbian custody battle files appeal

RICHMOND -- A woman suing for custody of a daughter born during a now-dissolved civil union has appealed a ruling that gives her former partner -- the biological mother -- full parental rights.

The American Civil Liberties Union of Virginia and two gay rights groups -- Lambda Legal and Equality Virginia -- filed the brief Wednesday with the Virginia Court of Appeals on behalf of Janet Miller-Jenkins, who has been granted visitation rights in Vermont where the couple lived after their civil union.

The groups are contesting a Virginia judge's ruling in August claiming jurisdiction in the case because the biological mother, Lisa Miller-Jenkins, gave birth to 2-year-old Isabella in the state and now lives there.

Frederick Circuit Judge John Prosser awarded full custody to Lisa Miller-Jenkins a month later, saying that Virginia does not recognize Vermont's civil-union law or rulings issued from it.

In September, Vermont Family Court Judge William Cohen declared Lisa Miller-Jenkins in contempt of court for failing to grant her former partner visitation rights. Last month, Cohen ruled that both women are the legal parents of Isabella.

I saw this pair on TV awhile back (I think it's the same one). They dissolved their contract IN ORDER TO play the courts.

Am I reading this correctly? The child was born in Virginia - not in Vermont - while the mother was living in Virginia - not in Vermont? If I've got that right so far, what does it matter what a judge in Vermont says? Vermont's "civil union" nonsense doesn't apply to Virginia and, unless the other woman's name appears on the birth certificate somehow, what basis is there for anyone to take anyone to court? Does the non-mother plan to pay child support, provide health insurance, etc.?

This is the kind of crap that will be going on all over when the queers who get married in Massachusetts come running into the courts in all the other states looking for divorces, property settlements and, worst of all, custody rulings concerning whatever poor unfortunate children they've dragged into their messes.

Which makes it even worse. Divorce is terrible to children, it is pure selfishness do this to them deliberately.

Love it when these nut cases end up fighting amongst themselves. The real tragedy is the child who is the prisoner of the adults dysfunctionality.
