Who knows? Maybe Kerry is still behind this. Maybe they tried to pull it off before the election but couldn't get it done in time. Or maybe Kerry decided not to pull the trigger on it because he thought he was in decent shape.
Obviously they've been working for a while to gather a group of people willing to sue.

Someone needs to tell these "men" that the UCMJ has nothing to do with either the Constitution or the National Labor Relations Board.
These "men" signed a contract. As I did years ago. Many men I work with as an Air Reserve Technician were due to retire during Desert Storm. All were kept in "Stop Loss" status until a month or more after hostilities ceased.
A second, larger group is now in currently in "Stop Loss" Status. And expect to remain in that Status for at least another year.
To quote a favored cartoon Super-Hero to his Sidekick:
"You knew the job was dangerous when you took it!"
These "men' are going to lose BIG and they are going to stay In-Country long after a decision has been taken!

I couldn't believe this one idiot in the suit. He joined in 2003 and complained because he was activated and couldn't just do a weekend per month. Guess he figured he could just get the free schooling then go home with no commitment.
I hope he gets hard time in Leavenworth.

The lawsuit contends the policy is a breach of the service contract because it extends the length of service without a soldier's consent. It's in the contract. This lawsuit is pure liberal crappola...

Yes. Here's what my Dad's WWII "Terms of Enlistment" says about length of service:
"Enlistment for the duration of the war or other emergency, plus 6 months, subject to the discretion of the President or otherwise according to law."
Since the Pres is the Commander-in-Chief, I assume that the "subject to the discretion of the President" phrase would still be in ALL service contracts...

When I read the NYT article last night ... this part caught my attention
One soldier's wife, from New York City, said she received an e-mail message from Military Families Speak Out, an antiwar group, about the possibility of a lawsuit, and urged her husband to be part of it.
However, I had no idea this lawyer was buds with Jane Fonda's hubby

However, I had no idea this lawyer was buds with Jane Fonda's hubby.ALL of the current anti-war notables knew each other back in the Viet Nam era. Thye've kept in touch over the years, waiting for a perfect opportunity to relive the 60's/70's.
To them, Bush = Nixon, and Iraq = Viet Nam. They're all getting old - this could be their last chance to finish what they started 30 years ago.
