Was not the reporter under the duty to hand over this tape to military authorities,under the rules of imbeds? If that's the case then strong measures should be taken against Sites. Also has Sites been removed from that Marine unit,because at this point i"m sure his presence is a distraction to the Marines and therefore endangers their lives. Sites has to be removed from that unit at the very least.
I think it is just plain old common sense that is lacking. He would rationalize that Tokyo Rose was a patriot if given enough time.

Read the embed rules I sent you a while back and find where the military has the power to obscure marines' faces. When was the last time any soldiers' faces where obscured on TV?

Yours is a valid question, however the "guilt" should fall squarely on Sites for not revealing he had prior knowledge of the wounded until after the Marine fired. Only afterwards, when the inbred reporter revealed what he did, the Marine said, "I didn't know, sir."
Why should the reporter not be held more highly responsible when he set the Marines up for this incident? If he knew they were wounded and unarmed, why was he crouched behind the Marines for "protection"?
IMO, this reporter should be hung out to dry and beaten like a pinata.
I have a feeling that if Sites is asked to testify he may say things that are actually benefical to the Marine's defense, either because of enlightened self interest or just maybe those are the facts.
