Judge removes juror from Scott Peterson's murder trial
Scott Peterson could face the death penalty if convicted of killing his wife and unborn son
REDWOOD CITY, Calif. Jurors who have been weighing capital murder charges against Scott Peterson for five days were ordered Tuesday afternoon to start from scratch after a panelist was removed from the jury and replaced with an alternate.
Judge Alfred Delucchi did not give a specific reason for the removal of the woman, Juror 7, but indicated in his instructions to the remaining jurors that the dismissed juror may have violated court rules by trying to investigate the case on her own.
"You must decide all questions of fact in this case from the evidence received in this trial and not from any other source," the judge added after reading jurors the standard, state-approved jury instructions given to deliberating jurors when one of their number is dismissed.
The extra sentence is part of the an official instruction entitled "Juror Forbidden To Make Any Independent Investigation." While that instruction is delivered to all juries before they begin deliberating, it is not normally read again when a panelist is dismissed.
Story continues ..........
Who was the lawyer for the other Peterson..?
I think he was the one who said the defense must agree ...(or mistrial in some east coast state?)..(He and his blowpoke.)
Harris???
Can someone explain the nature of all the attention on the previous juror who was removed? Why is his opinion being asked by all the talking heads?
Thanks for the replies. It didn't make sense to me that they would ever need a defendant's permission in a situation where the juror did something to warrant their dismissal. However, if for some other reason - I know it's being reported that #7 was doing some investigating and breaking some rule, but who knows what to think?
I think there will be smooth sailing now for the Jury. Now that they have seen what happens when one is not willing to rationalize (deliberate) their opinions. Strawberry shortcake better have good reasons to back her beliefs or that pack will get her. This is good as no BS ideas by anyone will fly in the Jury room, and the truth should prevail, which is what is supposed to happen. I think a guilty verdict will be coming before the weekend
Thanks, Melanie!
No the lawyer for The Peterson who who was convicted of murdering his wife who"fell" down the stairs..The one where Dr Lee spit catsup to explain all the blood spray high up on the wall..I think this same lawyer defended Rae Carruth?
I don't know why. I think his IQ is below college level. He is a creepy dude, IMO. I think the pundits, or maybe he is now a shill for the defense team, to keep the word out that the DA didn't do a good job and being paid for it??? JUST MY THOUGHTS!!!
Can't wait until "Pinky" appears on TV shows in the post-trial phase...
On the other hand, she may be the most intelligent person on the jury. One never knows in the Golden State.
Because as everyone knows, out here in fly-over country (the part of the map that is colored in red) we are dumber than a box of rocks and we'll believe that someone who spent six weeks on a jury is a bonified legal expert.
;o)
I haven't a clue..
I'm in fly-over too and that's why I can't listen to this guy...nor to any of the media on this case.
And there is Gerago's face on AOL and other articles, instead of Laci's, as a new juror is announced.
I think the judge didn't realize on Justin spewing his mouth all the time. Maybe that is why he now gaged Fran Gorman, juror 7?
I was just listening to the radio and they were interviewing someone from Court TV. He said that after the OJ trial, the governor of California tried to get a law passed so that only 10 out of the 12 jurors had to agree for a conviction - referred to it as the 2 flake rule. Said that statistically whenever 12 Californians congregated, at least 2 of them were flakes. LOL
He predicts that SP will be convicted and that it will happen no later than Friday.
David Rudolph. Recall they dismissed a juror the day after he was picked up for drunk and disorderly conduct while wearing his jury badge. Big "L" on his forehead.
